Drydensfairfax solicitors
Hi I have been pursued by cabot financial for a while and i have not made contact or payment in 5 years . After 6 years the debt becomes statute barred . My credit files are looking allot better than they did a year ago believe me ! I have received several letters from debt collection agencies loads threatening me with a ccj and nothing happened .
I have now got a letter from dydensfairfax difference being they are a solicitors . They are saying if i dont contact them them they will try and get a ccj for cabot .
I feel although i havent admitted to the debt , this time these guys are going to take me to court . Or are they just scare mongers I dont know I have no experience of them .
What do i do ask them for copy of original credit agreement ? just start paying £2 a week to them or do nothing ?
I dont want to get another CCJ.
I know often they try to get you to confirm your name and that you owe the debt but these are solicitors . that is why i am paying attention .

Starting 3 threads about the same thing will get people confused, stick with one and maybe people will be able to answer your question.
Have you asked for any information about this debt, do you know if it is yours, have they provided any proof that you owe it at all, get this information together and then come back and ask more questions.
Been here for a long time and don't often post0 -
What is this debt? Overdraft, credit card etc...
They are indeed solicitors and may well try to get a claim started before the 6 years are up. A claim stops the staute bar clock.
I think you should start with a prove it letter.
Please do not phone them.
The worst thing you can do right now is make a payment.BSC No 248

Was it full of words like 'May' 'recommend' 'possible' or ones like 'will':beer:0

Hi was full of words like we may,if,you should ,if we. Basically says I need to contact them there client may instruct them o try and get a ccj. I did have a barclaycard debt. I haven't made payment or admitted the debt to them or Cabot. I can't afford to get another ccj . Are they going to actually do anything ? Does the prove it letter admit liability to the debt . Is this the same as all the debt collection agency letters I have received and ignored in the past ( I'm worried as it is from a solicitors) will they contact me again before taking it to court ? I've seen online that this company do get people issued with CCjs if I have to I could start paying like £2 week . Or something . No contact made for over five years with company0

Standard letter then.
The prove it letter does not acknowledge the debt. Did you send them it?
When did you take out the card?
These idiots act on behalf of companies that buy iffy debts. Had a letter from them last week regarding a Capquest catalogue that's totally unenforceable in court.
I wouldn't pay them anything just yet.

The card was taken out well over six years ago.i haven't sent them prove it letter. Where can I get this from . Will this company Dryden fair fax send further communication before they ccj me ? They do ccj people though I have seen plenty of threads from people saying they got a ccj from them . The debt has been passed on from debt collection agency to debt collection agency and I didn't take too much notice . Just this is a solicitors . So it is getting more serious .0

Not really, treat solicitors like you treat DCA`s, provit letter can be found here :

sending them this, adapted for your situation, will automatically put your account on hold, they will then have to prove you owe the debt.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I had to contact them by today shall I email it to them0

No. The deadline is entirely random and purely designed to get you to panic and make poor decisions in their favour.desidereo33 wrote: »I had to contact them by today shall I email it to them
Some used to deliberately back date the "deadline" to prior to posting to enhance the panic affect.
Post is fine, but make it "signed for". Nothing bad will happen in the couple of days difference in them getting it.BSC No 248
