help!total parking solutions charge notice Scotland

hi,

I've received charge notice from total parking solutions, member of BPA.
I've parked my car (register keeper is my partner, letter came addressed to him) in the car park, that belonged to Brantano- it's been shut for at least two years now.
The shop premisses is now empty.
The car park is sort of divided into two parts- one belongs to Pets at home and the other bit to ex Brantano.
In the letter TPS is stating, that 'the vehicle was recorded parked on OUR client's property at Pets at Home/Brantano.'
From the photos, you would not be able to tell if I was parked at Pets at Home parking bit or ex Brantano bit (to clarify- I was at Brantano bit)

from pictures, you would see, the car entering from the main road, and the second picture is parked with the time when I was leaving the car park.

the fine is £90, or if I pay untill the 22nd of May- they will be so kind to accept £50.

I've read forums etc, but still not convinced if I should ignore/appeal or pay up.......

Advice, please???:A

    You're in Scotland so IGNORE. You'll get a few scary letters but they can do nothing.

    The ownership of the car park may not have been vested in the shops that it fronted and in fact that is highly unlikely. Almost certainly the shops and the car park are owned by a single retail operator and managed by agents. In other words TPS's client is probably neither Pets at Home and certainly not Brantano.

    Don't get too hung up about that.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Ignore them and all the threats they make. Its the only thing to do in Scotland.

    Yup, in Scotland you don't contact or interact with them at all - POFA 2012 and Keeper Liability does not apply up here, so they can only take action against the driver - So if you don't confirm that identity to them, there is no way they can take action against anyone (not that they are very likely to anyway!).

    glad I've checked it- I was waiting to get my wages in and pay up today their kindly reduced amount...
    I was fearing, that if they'll take this to court, my partner would be the one to go and that would be not fair, as it was me, who parked there....

    yes! IGNORE in Scotland!

    I've sent them an email, telling to get lost (mentioned about breaching Data Protection rights by obtaining details from DVLA, that I do not have to disclose them anything, let alone who was the driver and that their clients premisses been shut for couple of years)
    I've received another letter yesterday, threatening to pay.
    and there is an email, sent on the 27th of May.

    check this out :D there it is:

    Dear Sir,

    Thank you for your correspondence. With reference to the Charge Notice issued to the above vehicle, after reviewing our data and in view of the representations made in connection with its issue, we can confirm that we have decided to cancel this Notice and no further action is to be taken.

    Yours faithfully,

    Total Parking Solutions Limited

    Your partner couldn't have been liable in Scotland anyway as there is no keeper liability there.

    Well done on stamping out the drivel of the junk mail though, by one email (not so much ignoring as telling them to 'go swivel'!).
