Vendor still wants access after completion

Hi
So managed to agree completion date of 23/"5/14 and we
Exchanged yesterday (Hooray!):beer:

I did a last minute check and cannot believe vendor was adamant
to exchange and complete by 16/05/14 (I wanted end of may).

She still has so much packing and organising to do and was quite
distressed about the whole thing as she is packing up family home
after 13 years and divorce. She agreed to have everything cleared by completion date but then started saying that she may need to come in over weekend after completion to get things?!

I kind of said it would be ok as I felt sorry for her but is this normal
I thought everything had to be moved by completion. She agreed to give me all the keys on Sunday but just wanted to know other people's opinions...

  • Is she buying another place. If she still has keys what guarantee do you have that she is actually moving out? I wouldn't be having any of it

    Do not let her come back after completion. You should have vacant possession. Talk to your solicitor about this.

    You ensure, via your solicitor, that you get vacant possession, and ALL the keys.

    By the way, you should not be negotiating directly with the vendor, any such discussions should be between your solicitor and hers. Don't let her emotions affect your better judgement.

    How many "things" is she planning to leave in what will be your house and for how long?

    What will you do if you let her leave stuff and she doesn't collect them straight away? You could be stuck with them for weeks.

    I definitely wouldn't allow it - she can put her stuff in storage if she doesn't want to sort it out yet.

    What on earth could she be thinking of leaving behind? I'm assuming something large that needs a van and/or help to move. If it was small she could stick it in a car/taxi and be away. If it is large, what are you going to do with your stuff? So it's wrong practically as well as being wrong as far as vacant possession is concerned. I also beleive this could cause problems with your mortgage lender if you so not gain vacant possession on completion.

    Our vendor asked us directly approx 3 days before completion if they could leave some items in the garage and collect them the next day. They would have no keys / access to the house as the garage is detached and we agreed this was OK.

    It took them 10 days to finally come back and empty the garage (luckily we didn't need the storage). It was frustrating it took them so long but they were reasonable with us as buyers and thought we'd also be reasonable with them.

    I wouldn't let them leave anything in the house or let them keep any keys although you should change the locks anyway once you move in.

    Who would be liable if any of the left stuff was damaged whilst you moved in etc?
