Mutual Exchange Question

I am in the process of a mutual exchange. I have a secure lifetime tenancy (2009) with the local authorities and wish to exchange with a housing association tenant holding a shorthold assured tenancy with a fixed length of 5 years. I was under the impression that when swapping with a shorthold assured tenant, I would be able to keep my lifetime tenancy status, and would be offered the equivalent from the housing association, an assured lifetime tenancy.

The exchange is ready to take place, but I was informed by my housing manager that I would be taking on the other tenants tenancy agreement, stepping into their shoes, and would not be receiving an equivalent lifetime tenancy from the housing association. This meant giving up my secure lifetime tenancy for the assured shorthold tenancy fixed length of 5 years. I contacted the housing association and was told that the shorthold assured tenancy is what I will receive as the property is let at an affordable rent. In this case it means that I would be taking over the other tenants tenancy.

It seems to me I would be giving up a lot in this exchange, and wondered if it was correct that I should be stepping into the other tenants tenancy agreement or if I should be offered a new lifetime tenancy.

Any advice would be much appreciated.

  • :eek: thank dog you found out and did not just sign. I would never give up a secure tenancy. Take some advice on the implications of this.
