Ok, but they would count towards her pension though.

On a side note - and not directly related to the OP's original problem - if she were to be entitled to income-related JSA, am I correct in thinking that she could actually just go on Income Support instead as she has a child under 5 years? Therefore not having to jump through the JSA hoops?

Just trying to help others who may be in a similar situation but don't have a partner earning enough to disqualify them from income-related benefits.

Please correct me if I'm wrong.

Inome related JSA: My OH works and I am lucky that although its not an amazing wage its not low enough to be entitled to income-related JSA.

Not with her OH's wage coming into the household.

Thanks, I get that. Hence why I said not related to the OP's problem - because her partner earns too much - but to help other people understand in the future that they may not have to go on JSA if they can get Income Support.

Well I've received another letter from JSA saying that "a doubt has arisen on your claim to JSA because it appears that you have left your job voluntarily"

The leaflet that they enclosed with the letter states that I may be able to get some JSA under hardship provision.

Anyone know what evidence I'll need to show for this?

    Thank you

If you're not eligible for Income Based JSA, then I can't imagine for one second how you might be eligible for hardship payments - these are just a reduced payment of Income Based JSA made in order to prevent immediate and serious hardship to you or a member of your family. If things really are that bad you could consider applying to a food bank or a charity for assistance.

They would not be eligible for IS because they have a partner.
