(As far as being fined for having an uninsured car, they won't do this before first writing to you and giving you a chance to get cover. Though obviously don't take it on the road until cover is in place)
You're forgetting the continuous insurance requirements.

    No

I have explained the procedure used when continuous insurance database flags up an uninsured car.

They send out a reminder first before moving on to a fine.

I've just contacted Elephant.co.uk again. They have reinstated my insurance with some 40GBP extra admin fee.

The reinstated insurance takes effect from today and the renewal date stays the same (11th Apr, 2015).

Obviously they can't back date the insurance cover, so there is a 10 day gap between 00:01 5th of May to 24:00 14th of May.

Apparently they received my payment method update on 4th of Apr, but there was an error (the exp date of the card) which caused all the problems...

Hope the MID is not tracing after me :-)

It's true that in theory the keeper commits an offence as soon as the insurance lapses and the car isn't SORNed. However in practice the DVLA will send out a reminder letter at first, and won't do anything further if the car is insured promptly after the reminder goes out.

Yes, in this kind of instance, they can.

You can safely ignore post #12 which is just scaremongering.

What's the difference between reinstate the cancelled insurance, and get a new insurance?

I guess in both cases, I'll have to answer "Yes" to future quote question "have your insurance been cancelled in the past xxx years"...
    :(

it would be worth getting written confirmation that the cancellation has been removed from your record so you don't need to disclose that in future as it will cost you ££££.

If they won't play ball then complain & refer to the FOS if they still don't see sense.

If you do have to complain then I'd also be looking to get the £40 back by getting them to listen to the phone call when you gave the new card details to see where the mistake happened. As you were reading off the card then my money would be on them making the mistake

Edited to add: Actually, I'd be getting them to listen to the phone call anyway

I'll ask them to write this letter.

I'm not sure about the reimbursement of the 40GBP. Never recorded any conversation with these companies... Maybe should start from now on...

Whose fault was the wrong date? Theirs?

Stick a complaint in and ask for your payment back. Explain that you were on holiday but still checked your emails which was the preferred method of contact and there were none.

Nothing to lose except one letter and a stamp.
