Hello has anyone looked at the conditions of sale for their freehold purchase. I have just received an offer letter and condition 4 says ; that no messuage or dwelling house or other building or erection shall be erected on the land hereby transferred whether in addition to or substitution for the messuage or dwelling house and buildings presently erected theron until the location and the site of such messuage or dwelling house building or erection and detailed plans,elevations and specifications thereof shall have been submitted to and approved by the transferor or its surveyor whose charges theron shall be borne by the transferee,save that alterations for purely residential purposes will be permitted without a fee being charged.
Any idea what this means if laymans terms does this mean I have to get permission off them after I buy the freehold to put an extension on my property?0 -
No - it states 'save for .... purely residential purposes will be permitted and no fee will be charged' (I can't see the text whilst I'm replying so may not have accurately quoted, but the meaning's the same). An extension of the house to live in will be fine. I read it that a building, etc for a non-residential purpose, i.e. a commercial or other purpose, will require their permission and payment of a fee.0

I have experienced the same when I purchased the freehold in 2014 with Shenstone properties, I wrote a letter back to them asked them to remove all of the listed covenants at the reverse of the form before I can proceed the purchase of the freehold, received a response from her saying cross all the covenants listed at the revers of the form as they are not going to affect your property than sign the form return it to Shenstone properties, I did this at completion no restrictions been added to the freehold, it is reassuring to have a letter confirmation from them especially when you are not going to hire your own solicitor, hope this helps.0 -

Also I will be careful about the following quotation "residential purposes will be permitted without a fee being charged."
in my view this may also mean they are not going to charge a fee for residential developments but they may charge for the use of their surveyor to check on your proposed works as you will be still have to ask them for approval before you can proceed, this is not good for a freehold title, you should asked to remove the covenants. please that a fee to the freehlder is not the same as the professionel expenses exemple surveyor's and legal fees hope this helps0 -
I was really interested to read this thread, as we are planning to buy our freehold from Shenstone Properties, but we were unhappy about the conditions attached to the sale.
Can I just check - did you just cross out everything on the reverse of the application form? Does this then need to be signed?

I have just received my application to purchase freehold on my property, I have reading these threads for approx a week and have found them a huge help.
One thread in particular was from 'needster23' stating that they informed Shenstone that they understood there solicitor had a share in there company meaning conflict of interest!
I'm in the middle of sorting out application and just wondered if it's worth me stating this on application.

Well after waiting forever, we have eventually got our freehold, which then allowed our house sale to be completed.... Just to give you guys, some info!!! Mrs Jennifer Margeret Manselll, who no doubt you are all dealing with, is actually a Managing Director, as is her husband Mr Raymond Mansell No doubt you have all been told to use a solicitor in Brighouses, Mr Alan Epsley who guess what? ...he is a shareholder in Shenstones .....surely this is a conflicts interest? I made them aware of what I knew and amazingly my freehold was done and dusted in two weeks!!!! Hope I've helped and GOOD LUCK. This company should be outed as con artists,.
Could I please ask how you worded your response regarding above as I'm in the middle of sorting application and the sale of my property depends on this going through quickly 😔🙏🏻0 -
