NTK arrives 80 days after issue - PPS

Hi

Just had a 'notice letter' through

'You have been sent this Notice because the DVLA informs us that you were the owner of the vehicle XXXXXXXX on 17/02/14 etc etc'

about a windscreen ticket received from Premier Parking Solutions in February. I stuck to the advice on here and waited for it to come through before doing anything.

I read that they should send an NTK between 28-56 days? Does this alter the way that I appeal?

    . Appeal now stating you are appealing as the rk. Point out the notice is not in time for POFA to apply. Also say that the charge is not a gpeol. If they are stupid enough to continue, come here for popla help

    If their ntk states POFA applies or implies in any. Way the rk is liable, complain to the BPA and dvla

    That's a letter from CCS collect posing as PPS. They are a debt collector.

    Send a strong appeal/reply to them and to PPS and also complain to the BPA that PPS and CCS have breached their code of practice.

    PPS will probably try and tell you that you are not entitled to a POPLA code as they are only available to the driver who appeals within 28 days of the windscreen ticket. This is rubbish and a breach of the BPA code of practice.

    The main thing is to not identify the driver. They cannot hold the keeper liable as the NTK will not relate to POFA2012 and it is out of the timescale anyway!

    The sort of strong appeal to send is like the template in the NEWBIES thread that I expect you've already found, as you knew to wait for the NTK (not that this is a real NTK and it's too late for keeper liability). More fool them!

    Quick update.

    I sent off two letters, one to PPS and one to 'Valley Enforcement' (CCS) using the strong appeal template in the newbies and also included point

    The notice letter you have issued is dated 07/05/2014 for a PCN issued 17/02/2014. This is well beyond the 56 day limit set by POFA. This renders your notice too late for keeper liability.

    In the meantime I complained to the BPA who came back with

    "As the letter you have provided is not the NTK we cannot advise if it is outside of the required timescale. The letter provided however is compliant with the processing of a parking charge notice when an operator has not had a response from the motorist (after a Notice to Keeper has been sent).

    We suggest you contact the operator & request a copy of the Notice to Keeper to find out when they advise it was sent.

    Once the operator has provided a copy (& advises the Notice to Keeper was sent) it is very difficult to prove otherwise."


    So my question is, are the PPS justified in sending me a late (80 days) notice letter instead of a NTK? I definitely haven't had an NTK.

    Just a bit confused now!

    AIUI some PPCs do this ... send a reminder letter when having never sent an NtK (but alleging that they have), just SO they can try to work around the POFA time limits.

    If it does, then it does not comply with POFA 2012 so you cannot be held liable as keeper for the charge.

    I'd imagine PPS will come back and say that your appeal is denied and that it has been passed onto debt collectors and they will not enter into any other correspondence with you. They will not send a POPLA code.

    In this case you should then complain to the BPA that they have breached the code of practice for not supplying you with a POPLA code upon appeal. POPLA codes are available to drivers and keepers of vehicles.

    Valley enforcement and PPS are the same company.

    CCS are based at 797 London Road - did you send an appeal there?

    Yes, sent a copy to 797 London Road - so guess I just have to wait now.
