I kept the receipt for the recorded delivery so I can see the electronic signature and the name of the person who signed it. I also have a receipt for the postal order. Is there any way I can check if it was cashed?

Thanks for getting back to my queries I'm a bit unsure about all this.
I know £249 isn't a lot of money but I'm getting stressed with all the letters.

Hi Chanz4, I honestly don't know. I have no memory of the account.

I received another letter today, which was sent on the same date as the final demand and signed by the same person, this one said my account had been up for a review and to ring them urgently. Obviously I won't be ringing them.

would anyone know where there may be a template to tell them to leave me alone until they send me a credit agreement? If I get one I will happily pay.

what are the repercussions of not paying a £249 debt be it mine or not (apart from the mark on your credit file)

Apparently the account was taken out in October 2008 and defaulted in October 2009, any idea when this would be statute barred?

    Thank you

It would be statute barred after the default date so long as no payment has been made and the debt has not been acknowledged since that point, so 2015.

They'll likely play silly beggars as it sounds like they're just fishing.I reckon you either won't hear from them again or they'll send you incomplete documentation. Ensure that the £1 for the CCA is NOT played to the debt - DCA's have a nasty habit of doing this and if they do, so long as you used the template on here saying that pound was only to be used for the CCA and not to service the debt, you can report them to the likes of the FOS and OFT.

I did use the template, and the balance on the account hasn't changed.

will they be using the fact that I forgot to date the cca to their advantage?

    Hi,
Would someone know if me forgetting to put a date on the cca request has made things difficult?
    I'm a bit worried.

    Thanks

as this is a debt taken out after 2007, the cca letter does not apply ..does it?? i do think the only way out of this ..if your sure you did not use littlewoods is for the police to be involved for fraud..you may want to think carefully if you did orders stuff. i hope someone can confirm about the cca request for you but im sure its only for accounts opened before 2007 maybe you need a prove it letter instead?
goal for 2014....i will manage money better ..must resist shopping..............:A

Any idea where I can get a template for a prove it letter?
Surely them not replying to the cca request still puts the account into dispute?

I'm even more worried now :(

    Hi

They still need to respond to your CCA request, even if taken out after 2007. They can't get a CCJ until they do so. They just no longer have to produce the original, preserved, shiny original copy.

As for the date, you can always send them another one, but the signed for receipt has a date so it's fine.

This is the prove it letter:

    Have they contacted you recently?

Nothing since the final demand and account review letters, I got those a day apart last week.

thank you so much for getting back to me.
am I better sending them a letter to say that they are in default of my cca request?

    Thank you

Yes, you could complain and ask them why the have failed to comply with your CCA request.
