Hi,
Apologies if this has been posted in the incorrect place.

I have had correspondence from EOS Solutions claiming I owe a debt of £249 for a Littlewoods account. Foolishly I rang them to see what it was about. I requested that they send me an invoice for the debt detailing exactly what was purchased, as I have no memory of this.
Around a month later they sent me what looked like a copy and paste of an excel spreadsheet showing that £100 was for products and £149 was charges.

I sent them the standard dispute letter, also requesting that all future correspondence was in writing. They responded with a letter to confirm my address at the time the account was taken out, which matched the address they had on record. They had mentioned that they would contact the police if I suspected this was fraud. I don't want the police to be involved as I can't remember ordering anything from Littlewoods, that doesn't necessarily mean I didn't.

The next week I received a letter saying that the case had been passed to their directors office as it was seriously outstanding.

I then sent them a CCA request with a postal order of £1. This was received by them on 17th March. I have had no acknowledgement from them.
Today I have received a statement of account with a balance of £249, however no credit agreement. The statement of account appears to be a standard letter, with no mention of recovery action.

I haven't acknowledged the debt and have not made any payments towards it.
The account was apparently taken out in 2008 and defaulted in October 2009.

Can someone give me some advice on what to do next? Am I going about this the wrong way?

    Is it on your credit file?

    I would send them a written complaint, signed for, stating that they have failed to prove its your debt and as far as you are concerned you have no knowledge of the debt. State if they ignore your complaint, you will be referring them to the FOS.

    State you expect them to prove its your debt or to stop hassling you.

    Thank you for getting back to me.
    I will have to have a look at my credit file, though I haven't had any issue getting credit, I took 2 car loans out in 2012, both of which have not had any missed payments.

    Should I wait for them to contact me again before I write them a letter?

    Yep, wait fir next letter.

    Then complain and Ask why despite them signing for your CCA for the alleged account have they they not provided it within the 14 days allowed. Prove it or go away.

    I still have not received a credit agreement, but today I received a final demand for payment. Can anyone provide me with any pointers on what to reply to them with?

    The CCA request was signed for on 17th March.

    It will be a computer generated letter, just reply that the account is in dispute due to them not complying with your CCA request, and you will not communicate further with them until it has been complied with.

    so which is it didn't order the item or didn't have the account? If you never got the item let them go to the police as would be easy to resolve then.
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    Hi Chanz4, I honestly don't know. I have no memory of the account.

    I received another letter today, which was sent on the same date as the final demand and signed by the same person, this one said my account had been up for a review and to ring them urgently. Obviously I won't be ringing them.

    would anyone know where there may be a template to tell them to leave me alone until they send me a credit agreement? If I get one I will happily pay.

    what are the repercussions of not paying a £249 debt be it mine or not (apart from the mark on your credit file)

    Apparently the account was taken out in October 2008 and defaulted in October 2009, any idea when this would be statute barred?

    I have just looked at the cca request I sent them, I forgot to put a date on the letter!! Does this make it any different?

    Just ask for a copy of the pod that was signed with the delivery / item description
