PPI is not a legal issue. It is one that the regulator has put in place. The requirements under the regulated complaints process are higher on the firm than a court would require.
If you take them to court, the onus is on you to prove that they broke the law. FCA guidelines are not laws. Plus, insurance was not regulated for sales until January 2005. Yours appear to be before this. So, you couldnt even suggest to the judge that he considers using FCA guidelines when they did not exist at the time (in the unlikely event he/she would).
So, what evidence do you have to show a breach of law by the seller that you would supply the court?
Ah, I see! That makes perfect sense. You are right of course, although I was led to believe that the PPI was compulsory when I took the loans, it wasn't actually illegal or against regulations to do this.
I shall still have a go, you never know. Nothing ventured and all that. And like I say, is only a couple of pounds for first class recorded so worth trying.0 -

(b) It's a weak complaint for which you can provide no evidence. Hearsay complaints are universally rejected unless other faults are found with the sale of your PPI.
You will have no access to the Ombudsman (as it's pre-regulation) and any attempt to pursue this through the courts would be futile and potentially very expensive if costs were awarded against you.0 -

Did Welcome sell you the PPI or did you get the loan through a broker?
We had a couple of loans with Welcome with PPI on both sold to us via a broker and it was them we pursued and not Welcome.0 -

As advised by Stupid Question, Welcome will look into your complaint only if you bought the PPI after Feb 2003.0
