for info to the OP and others :-

its worth pointing out that having a motability car does not exempt anybody from paying a parking fee or charge on any public or private land , neither does the disabled "tax disc" either (which are due to be phased out later this year)"

    Phased out?
Does this mean she will have to pay for her tax disc when this one expires or is something else taking it's place?

Just been on the phone to my mother in law as she is so distressed about the whole situation.

I have told her what people have said on here and about the letter and everything and even though she is still worried, she seems to be a little better than before.

I will keep you all updated on this topic as it progresses.

    Kind Regards,
    Chiller.

the discs are being "phased out" to save money , zero exemptions like there are now are still in place and alternatives will be offered in paying for the "road fund license" in monthly or maybe quarterly or half yearly or yearly payments will still be in force or brought in, so the motability car will still be exempt as it is now but no disc will arrive in the post at renewal time

my point is that there will be no "disc" showing the disabled classification come october 2014 ( no badge , no proof of exemption)

bear in mind this has nothing to do with your mother , its merely nobody in the family actually checking the rules or exemptions properly, which has brought about this situation , therefore you must all learn from it

even if the lady had a BB that doesnt mean parking was free (unless the signs say so) , many private BB parking spaces (and some council ones too) still require payments to be made , even if the time you can stay may double , like near me

the simple point to take away from this is that you should not expect a motability vehicle (or a BB for that matter) to be like an invisible shield , it is not exempting everybody from everything , its still subject to laws , byelaws , rules and exemptions

the main issue here was and is the EQUALITY ACT 2010 , not the motability car , not the "tax disc" , not even the BB (or lack of a BB)

Re-assure her that the forum has an excellent record in helping people get these charges cancelled either at the 1st appeal stage or at the second stage appeal to POPLA.

Be prepared that 1st appeals are more often than not rejected - but don't worry that is the expected result and gets a POPLA appeal code. The registered keeper then goes on with forum help to submit a winning POPLA appeal.

In the last 12 months there have been hundreds of forum supported winning POPLA appeals (only one didn't win and that is under review by the lead assessor due to errors in the orginal assessment).

You will be able to help your M-i-L do this by genning up on what's needed for a winning POPLA appeal while you wait the response to the 1st appeal template letter.
  • Hi again, I have the letter and I have an email address and a postal address for them.

Which is better to contact them on and if I post it, what is the best way of sending it?

    Kind Regards

    Letter with proof of posting

I haven't posted anything in years, would that be "recoded 1st class" or should I use the special delivery 24 hours "signed for" service?

Yes don't send recorded, just ask for a free proof of postage
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Neither! Far too expensive and they'll not sign for it which will scupper your letter being delivered at all. Normal 1st class post but take it to the PO counter and ask for a certificate of posting ( a receipt with the postcode on it) and keep that!

Personally I would email it. Excel do allow email appeals I think (check the silly fake PCN).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
