Parking Eye County Court Letter-Help/Advice please

Last year I received a postal parking fine from pe whilst usinga car park ‘run’ by them whilst on holiday.

I researched online and at the time thought the correctinformation was to ignore all correspondence completely, which I did. I nowknow this was not the correct information!

After not hearing anything since last Sept/Oct and thinkingthat was the last of it, last week I received a county court letter from them.

I have logged online and marked I wish to dispute the claim,and therefore spent quite a lot of time trying to research what I need to putin my defence.

The more I read the more I confess I just feel totallyswamped with what I need to put/ not put.

I have written to the land owner which is a local hotel butso far not heard anything back from them.

A basic run down of what happened:

Paid for parking at the meter imputing the car reg( notnoticing Any signs to say this was run by pe, etc), had a walk about and cameback to the car within the time stated on the ticket ( a ticket which I had until3 week ago when I stupidly thought I no longer needed it and chucked it!!!- Theticket would have been a great defence as the times on the ticket were a good10 min out from what their parking fine is stating- i am so annoyed withmyself!!)

Anyway as I said back to the car within the time limit,however upon removing my then 11 month old from his pram, found he had had ahuge nappy explosion! Roasting hot day, him & pram covered in poop……cleaned them both up and left the car park without any thought that may of thenlead us to be over the time (although again going by the ticket it would havebeen maybe 5-10 min over max) not the 35 min they are stating on there letters-although the court claim letter says none payment –guessing this is what theyclass it as.



I am just at a total standstill of what I should be saying& running out of time to get my defence in!

Like I have said I had read and read but just seem to begetting so confused, however I still do strongly believe I should fight this asthe £160 they are asking for, compared to the time we were over-in a empty carpark therefore inconveniencing no one and for a genuine reason is completelyott!

Any simple/ easy to understand info to someone who has noclue about this side of things would be greatly appreciated!

(2nd time i have tried to post this, the first time mylittle boy tired to help pressed a button and it all disappeared!!)

    Hi MCbm,

    When is your deadline for your defence to be in?

    You will need to get your head around the fact that what happened on the day will be largely irrelevant and your defence needs to be based on the legal arguments that can win this for you.
    So unfortunately there will be quite a bit more reading.

    Post #5 of the NEWBIES thread is the small claims info & links. Shows you what happens when in terms of allocation of the case to your local court, etc., examples of PE defence wording to adapt, then how to really PUSH for POPLA instead - we'd be pleased to help you. Also keep an eye on the outcome decision in the PE 'test case' from Cambridge - decision on that court case is imminent and will be discussed on this forum without a doubt, whichever way it goes.

    Please tell us was this a Newquay car park - Headland Hotel?

    Hi coupon-mad,
    The car park in question was the Atlantic Hotel, well the one just down from the hotel & actual car park but is classed as Atlantic hotel in the PE paperwork. Email the hotel to no avail.

    Thanks Collies, ive bought the prankster guide last night, my head is full of it! Will be reading again tonight to see if i can make more sense of it!
    Hoping to get my father to help me out too- as a 28 year old mum to a 2 year old, peace and quiet and time to try digest all this is rare! Hoping my dad can make more sense of all the legal jargon and help me out! Only have until Thursday to but the inital defence in...... so yes i have left it late, but illness/work time has just disapered!

    I did post a few days ago but now can't find my thread!
    I have until Friday to submit my defence against a overstay (30 min by there cameras) less by my reconing.
    Both me & my dad have trawled for hours online, pranksters book etc but are coming to a stop with how to word the defence and also what is relevant for that stage or what is for te next stage when I apply to my local court for popla (which I think we have a decent letter draft done)
    Any help in how to word the defence would be greatly appreciated as I don't want to mess the whole thing up & look a fool!
    If it helps the car park was Atlantic Hotel Newquay ticket was purchased just late to leave.
    Any advice massively appreciated!!!

    Are you certain you have to get your defence in that soon?
    Only you mentioned that you had received the papers last week and have acknowledged the claim.
    What option did you actually select?

    If it was that you wish to defend the claim in full I was under the impression that gave a total of 28 days to submit your defence.

    Others more familiar with small claims procedures will be able to advise whether that is actually the case.

    Would suggest you post up the defence you've drafted so far for help
    It's also worth posting for help on https://www.pepipoo.com as there are a number of forum members there also who are very familiar with helping construct defences for small claims
