Virgin Media Say I Entered Contract When I Didnt???

i have been with virgin ( telewest ) for the 15 months now,
for the first 11 months it was ok until sky one was dropped then i phoned and complained that i did not want virgin anymore, and they said they would drop my total cost by half which they did and i asked if this was a new contract and they said no, as my 12 months werent up, i made sure it wasnt another contract, so went ahead,

only today i phone up basically to complain about there crap broadband service ( keeps cutting off) and the premimium rate phone number you have to phone to check if your broadband is ok, and the man said that i am in a contact,

i argued this til i was blue in the face and he insists that i am in a new contract from when i phined up last , i know 100% that i did not enter another contract what can i do?????

did you ask them to send you that you wouldn't have a contract extenstion in writing? If not, then it wouldn't have much weight, as it would just be a case of your word against theirs - and if they don't record conversations, then there is no evidence to back either claim
  • About the same thing happened to me.

I called them 3 months ago to complain and I was given a Goodwill discount for 12 months.

I received my bill today and the refund/adjustment had disappeared.

I called them and finally got a manager telling me that it was written 3 months and not 12 and there was nothing they could do.

I really felt cheated since it was my word against theirs....

I accepted the deal at the time because it was 12 and not 3... I wrote a complaint but I'm not sure if there's anything else I can do.

According to their ad, we're the winners but here I really feel like the loser....

... exactly the same has just happened with me. They said that when I called in March to complain about the loss of the Sky channels, the price reduction I was given then triggered a new 12 month contract. At no time was this ever mentioned, there's no way I'd sign up for another 12 months.. it was annoying enough to have to put up with another 5 months.

They know that people won't be recording conversations at home, so they are just blatantly lying, being fairly safe in the knowledge there won't be any evidence against them. Surely they have to be able to prove that they did say there was a new contract, rather than me have to prove I didn't? Otherwise they could pretend I agreed to only watch TV wearing green gloves and balancing a cup of tea on my head.

For those of you experiencing contract clauses with Virgin Media, let me remind you that your contract with them has been breached since they have introduced the premium rate number, at no point did any of you agree to those terms, if they say you did, they need to prove this in writing, if they cannot, your contract is rendered INVALID, so just tell them your cancelling due to a breach of the T&C, give them the date you will be cancelling the DD, and inform them that should they wish to get any further monies from you, they can do it in a court. Be sure to remind them you are recording the phonecall too...but dont be bullied by there claptrap.

... interesting, marleyboy.. thanks for that.

I've called them again over the issue and may have some good news. I challenged them to show me where the proof was that I supposedly signed up for 12 months, said I'd see them in court cos the DDebit would be cancelled anyway and that was the only way they'd get payment. The guy put me on hold for a couple of minutes and came back with.....

... the woman I spoke to before didn't realise that I'd got my discount before the "new 12 month contract" rule went in, and as it's the same code input, it would have looked to her that I still had it. Yeah right, I know it's a load of bulldust but it's how they are explaining the "error". BONJOEY, my call was made on March 9th so if yours was before this, quote this codes/dates thing. Shocking way to run a business... I just wish Sky was a feasible install for me.
  • We had the same problem with Virgin, we have not had a phone line since the 28th may!! our virgin box keeps sticking and the broadband can be slower then dial up! we had 6 tech guys out and not one could fix it and 2 no shows. Had 3 arguments with customer services and ended up cancelling my account only to be told we have to give them 1 months notice at our cost!!! so we have switched to sky and got a great deal by telling them we were leaving virgin to go to them.

wirlwind, if it's not too cheeky, could you give me a rough number with this great deal? Looking on the Sky website, for the 2 Mix + Sports Mix TV, 16Mb broadband (I know it's much worse than that in reality) and a Sky+ box, I'd be paying £54 a month to sky plus BT phone line, so a total of £65 for my phone, broadband and TV. Do sky beat even that if you tell them you are coming away from cable?

BONJOEY, this may interest you. I just called them "to cancel" and after a bit of to-ing and fro-ing I got a further discount of a tenner off my monthly bill. Interestingly, they offered to start my contract either from today, OR from March 9th, meaning I only have an 8 month tie in. I presume I was only offered the choice because it was obvious which one I'd take. I can only assume they must have license to give better discounts when they did their new contract thing in March - the time they offered people the chance to get out of their existing contract for free.
