Amazon claim

Posts: 90 Forumite
Hi folks.
Long story short
Buyer bought item 7 months ago in Oct. Raised claim on 25 April.
I deleted my account in December - Couldnt reply to buyer, log into Amazon or anything as account was deleted.
Was a nightmare getting through on Amazon as their system is email based, they couldnt look me up etc etc. Finally got an answer from someone who said as it was xxxx time ago, a refund wouldnt go through, but upon checking today, they have sent a request to my bank account and the money will be withdrawn.
So, how can a refund go through for an order 7 months ago, as this is outside 90 days?
Are they allowed to store bank details on a deleted account?
Thanks

I would not think this is okay - especially since it is so long ago :S Did you offer a warranty on the item?
Have you contacted Amazon again to find out why they still have your details? Btw if you are having trouble getting through the email system, the number is 020 7084 7910 or 0800 4961081.The truth is out there... and I want to believe0 -
I sent an email to an address submitted by the rep. payments-guarantee@amazon.co.uk
I was on the phone to them today. Didnt really get any further as they cant sort this out by phone :mad: they wanted me to email them.
Anyone else had this before? Even if I did offer a refund, not that I know of, how can they refund using my account which was deleted?0 -

Yes.
All businesses have to keep detailed financial records, not only for HMRC and auditing purposes but also to comply with legislation such as money laundering regulations and the EU payments regulations.
If banking details were deleted as soon as an account was closed, it would make it far easier for crooks to launder and transfer money without getting caught.0 -

I should have worded that better. I understand this BUT they have used my details for a different purpose. Yes, I can understand using this is there was a huge case of money laundering. So if police request details they can access them...
However, they have stored mine, after a account deletion and withdrawn money from it and are "dipping in" so to speak
I dont know how to explain properly but do you know what I am getting at? Its like they are re-accessing my details for their gain and not for lawful reasons etc...0 -

I have to agree- I don't think they are using the details correctly - they are not simply storing them but they are effectively 'giving them' to the claimant - not in that they are actually giving over the details entirely, but they might as well.
I get that companies need to keep records (we have people who have bank details on their accounts at our company but we have never used them if the client wishes to close the account), but I do think they are being underhanded (unlawful possibly but I do not know the law).
If they are not able to sort this by phone, go to Citizen's Advice, get some advice on what is right and just to ensure this is not right, then send a letter to their head office.
It's a real shame that Amazon do not have like stores you can visit (they have a huge warehouse near me but I've never been into it) as I find it much easier to sort things face to face as they cannot back away from it. But never the less, persevere!The truth is out there... and I want to believe0 -
All I have been doing is going in circles. I need an email address for them to bring up "me"... as my account was deleted, it wont show... "but Mr.... we need your email" After about 20+ minutes talking to we know who I submit my order number which brings up the order but thats all.
An order number is not sensitive information so Im really no further forward other than begin given an email address which I dont expect to hear from.
My bank said they will send a claim for me but... The whole thing cant be right. How can they refund the buyer outside a return period? If they can, they have used my details in a sketchy way after account deletion.0 -
I expect this was probably all laid out in the contractual agreement you have when you start selling on Amazon. Just a guess.Warning: any unnecessary disclaimers appearing under my posts do not bear any connection with reality, either intended, accidental or otherwise. Your statutory rights are not affected.0

The storing of details is fine with me.
The part "we will refund a buyer when they are 4 months outside the return period" I am not happy about
1. The Amazon A-z Guarantee
1.1 AMAZON WANTS YOU TO HAVE A SAFE BUYING EXPERIENCE. IF THE BUYER OF AN ITEM HAS PROVIDED PAYMENT TO THE SELLER, BUT THE SELLER DID NOT DELIVER THE ITEM, OR, IF THE BUYER RECEIVED THE ITEM, BUT IT WAS MATERIALLY DIFFERENT FROM THE SELLER'S DESCRIPTION OF THE ITEM, AMAZON WILL PAY THE BUYER UP TO £2,000 OF THE PURCHASE PRICE, INCLUDING SHIPPING CHARGES SUBJECT TO THE FOLLOWING CONDITIONS. THE FOLLOWING CONDITIONS APPLY TO THE AMAZON A-Z GUARANTEE:
(1) THE BUYER PURCHASED THE ITEM ON AMAZON.CO.UK MARKETPLACE AND PAID VIA THE SERVICE.
(2) THE BUYER MUST WAIT 30 DAYS OR SHOULD THIS OCCUR FIRST, THREE (3) DAYS AFTER THE ESTIMATED DELIVERY DATE, BUT NOT LONGER THAN 90 DAYS, AFTER THE ORDER DATE TO REQUEST PAYMENT FROM AMAZON UNDER THE AMAZON A-Z GUARANTEE AND SUBMIT THE GUARANTEE SUBMISSION FORM;
(3) THE BUYER MUST PROVIDE THE REQUIRED INFORMATION ON THE GUARANTEE SUBMISSION FORM TRUTHFULLY AND ACCURATELY TO RECEIVE PAYMENT;
(4) THE BUYER IS LIMITED TO A LIFETIME MAXIMUM OF FIVE CLAIMS ACROSS ALL AMAZON SITES; AND
(5) THE BUYER MUST NOT REQUEST A CHARGEBACK FOR THE FIXED PRICE PURCHASE FROM THE ISSUING BANK.0 -
Do you think there are any extenuating circumstances where this part of the agreement could be over-ridden such as the item turned out to be counterfeit or illegal. Please don't take this the wrong way.Warning: any unnecessary disclaimers appearing under my posts do not bear any connection with reality, either intended, accidental or otherwise. You'll have to ask amazon how the buyer was able to file a claim in April for an item sold in October the previous year, as I don't think the system should allow this.0
