This can't be right can it? (DVLA)

Reference the latest flurry of PCN's, I wanted to confirm separate DVLA requests were made.
I called the DVLA yesterday, I was told I had to email or write in, so I fired off an email asking for details of all requests made against my vehicle by private parking companies.
Today I have got this back from them, and it doesn't seem right at all.

That V888 form is to request keepers details for non ATA members - Like proserve at Ransom's europark
I know the details, they are mine
I want to know WHO and WHEN my details have been requested by PPC Scammers. (No names mentioned)We’ve had to remove your signature because your opinion differs from ours. Dear DVLA,
Thank you for your response. Unfortunately you have not actually read what I was asking. I already know who I am and what are the details of my vehicle. As such form V888 is entirely irrelevant. What I am seeking is information on who else (private parking companies) has requested my details from DVLA ... please provide this information in the format:
PPC name - Date(s) of request(s)
There is no charge applicable for this request, as I am seeking request status about my own information.
Regards,
Me0 -
Make a complaint that your details have been misused. complaints are still free at the DVLA.Je suis Charlie0

Thanks, I have sent that to the DVLA.
Just seen this on the form;
B. Information about a vehicle that was previously registered, or is registered in your name – the fee is £5. (Fill in sections 2, 3, 4, 5 and 7)
But it is not information about the vehicle that I want. I want to know who has requested MY details.

Got a response from a FLM now, seems the fee does apply as does the prior advice to fill out the V888 form. Is it worth paying £5 to find out if the PPC "Recycled" my data when the BPA/DVLA wouldn't do anything about it even if they had?Dear Mr Trubster,
Thank you for your e-mail of the 7 May 2014. As one of the managers of the Vehicle Record Enquiries section this has been passed to me to reply.
I must advise that this type of request would not come under the Freedom of Information Act. As you require personal information held at DVLA, the application would be considered under the Data Protection Act 1998 and dealt with as part of day-to-day business. I can advise that this type of request is a Data Subject Access request.
You can request this information in writing along with the required fee of £5.00 or by completing a V888 form ensuring that you supply your Vehicle Registration Mark. Please submit a cheque or postal order of £5.00 , made payable to DVLA.
It may help if I explain that a Data Subject Access Request involves the data subject requesting information from their record (vehicle record, driver record etc...) Your request for information falls into this category.
Under Section 7 of the Data Protection Act 1998, a person is entitled to be informed of the personal data that a data controller holds on them if they make a request in writing and pay a fee which does not exceed the prescribed maximum. The office of the Information Commissioner (previously called the Data Protection Registrar) has prescribed that the maximum fee that can be charged is £10.00.
If you require confirmation that the fee is permitted under the Data Protection Act, you may wish to contact the Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, SK9 5AF or visit the website at https://www.gov.uk.
DVLA’s Data Sharing Policy department issued guidance in April 2013 that these sort of requests should now carry a charge due to the amount of requests that we were getting and the resource required to deal with them.
I trust this clarifies the position of the Agency on this matter

Have you thought about complaining to your MP? I'm not sure if it would help, but if all MPs received numerous complaints about this it might prompt them to do something.0
-
So, we cannot GIVE you the details you want, however for a fee we will tell you anything you want and sod the Data Protection laws.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0
-
The data protection act is about personal information, as a PPC is not a person, would the details fall outside of the act.0
