yep, but as in the case I linked to above, if there is no negligence on the part of the driver then there is no liability and that applies to the insurer as well.
NHS have a statutory right of recovery which is strict and so over-rides the negligence requirement in tort.
I can't see anything in the highways act s 41 & 130 that gives the council the same rights0 -
To the people saying we pay taxes for this...so what if you take out someone's garden wall - you expect them to pay? Pass bill onto insurers, or if you didn't declare it then pay it. Simples.
Hardly a comparable situation. For starters tax payers don't pay in to a pot to repair walls on private land!! Yet we all pay in to a pot for highway maintenance, healthcare, emergency services etc0
