    Personally I think this is real shoddy. We pay our taxes for public services and now we're finding we're being billed by highways agency, fire service, nhs when we utilise it. Bit of a double whammy

    When you hear local councillors boasting of big "efficiency" savings that often means collecting the cash by means other than council tax e.g. by raising planning charges, invoicing for road clean-ups etc. You don't get ought for nought.

    Suing type of culture slowly finding it's way into our society from The States I'm afraid to say. Everyone thinks that someone owes them all the time. Road traffic accidents have happened for decades on our highways and local councils have needed to attend to tidy up the mess. On the Beeb programme, a person was charged for an accident that wasn't even their fault. Councils with shrinking budgets are looking at ways of recuperating funds where possible and who are the easiest targets? Motorists of course!

    I don't understand why the OP doesn't just send the invoice off to their insurer. The OP will have a claimed logged anyway since the car was a write off.

    No need to even get involved.

    My partner didn't go through insurance as the car wasn't worth much and didn't want to lose no claims so through the insurance isn't possible.
    By "written off" I meant that the car was not usable and was scrapped.

    So I'm guessing they weren't informed.

    Your best bet in this case is to just pay it.

    Many policies, in fact all of those I've ever had over 30 years, ask for this. It shouldn't affect the no claims bonus, but it may well affect next year's premium.

    If not reported it could, and I stress could, cause problems if the insurance company find out.

    Bad driver? It was actually caused by the driver having an epileptic fit (his first) so no blame on him. Although he was never able to drive LGV's again. Also the reason for so much damage as he never even braked....

    Liability for damage & debris on the road only flows from negligence.

    If it was an unexpected first epileptic fit then there is no negligence and hence no liability

    Basic common law of torts

    If someone crashes into you as a result of an unexpected fit/heart attack etc then they haven't been negligent and so you won't be able to claim against them for your damage.
