Hi all
New to the forum and have been reading a few threads.
I have had 2 charge notices from PE for a car park in Southport. Both mine & my wife's car are registered to me and both entered & left the West St carpark at the same times as each other, about 20 mins over the allotted time. My daughter and some of her friends had a great time at a craft workshop which over ran, (in a shop served by the car park), then had pizza in 'Ask' (also served by same carpark) for her birthday, but poor old dad is not happy to receive these notices.
Using a template off here I appealed both notices to PE, but unfortunately could not provide a copy of the Ask receipt. I have since found the receipt but PE rejected both appeals and I now have 2 POPLA letters.

So appeal to POPLA.
You have obviously done some research in order to find out the info you have so get back to the 'Newbies' thread and find out how to win at POPLA. Nobody will do this for you but if you attempt it yourself there will be support provided.0 -
As tykesi has advised check out the How to Win at POPLA sections in the NEWBIES thread for advice and template appeals then post up your draft for comments and advice fine tuning it. Same POPLA appeal can be used x 2 to challenge each charge separately.
The receipt will be of no use for POPLA as that will be classed as mitigation which is explicitly disallowed in POPLA appeals but in addition to submitting your POPLA appeals - you should approach Ask and the store holding the workshop to see if they can get the charges cancelled.0 -
Have emailed Ask and will let you know how that goes. I will also draft something up for you guys to comment on.

You will - you can pretty much use any recent Parking Eye POPLA example - there are some on the last few pages, there are some in the 'How to win at POPLA' hyperlink too. All of them now cause PE to give up, they don't even rebut the appeals from us now.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Am in the process of drafting my popla appeal for you guys to scrutinise. Came home tonight to find a very 'odd' letter from PE going on about REJECTION OF INVALID INVOICE.
I never sent them an invoice! It's obvious it's a standard letter (unsigned, dear sir/madam, etc) but what the hell are they on about?0 -
PE issue two PCN's
you appeal and get 2 POPLA codes and win
cost to you £0 and 5 minutes work
cost to PE £54 + VAT
1. There was no contract between PE or the landowner and the appellant as this was a free car park and no consideration was provided by the appellant
2. As this was a free car park there was no loss whatsoever to PE or the landowner. The charge is therefore not a genuine pre estimate of loss and any costs mentioned by the operator are purely their fixed business costs or self imposed costs of chasing a debt that never existed in the first place .
That should do it0 -
It was not a free carpark - tickets were bought but the time paid for was over run, by 20 minutes at the end of the day when the car park was all but empty.0

ignore point 1 then , although you could adjust it to read that there was no contract with PE as the consideration provided was paid to and retained by the landowner who would consequently be the contracting party
and adjust the wording of point 2 that the only loss is the inadvertently underpaid parking tariff and thus the charge is clearly not a gpeol .......0 -

Could it be from the template used to appeal? Some of which mention the £18 per hour charge etc, should you win at POPLA.0 -
