Devere Parking PCN

Hi all,
I've had a look through the newbies thread for advice but I have seen that it says to start a new thread if the PCN is issued by Devere Parking Services Ltd.
I received a ticket a couple of days ago in a private car park whilst visiting a friend. Apparently there is a sign stating a permit should be displayed, but I was informed by three people in the building that I would not need a permit. The charge was for £100.
Can I still appeal this if the sign was visible?

Yes you can appeal this, but Devere are one of those companies that do issue claims so it's important to get this right. The initial appeal is the same one as the one in the newbies thread. It's the second popla appeal that needs a few alterations.
It's also advisable to appeal now as the registered keeper as this lot jump straight to debt collector letters and pretend a NtK has been sent when in fact they are lying! Just get a free proof of postage from the post office, and send electronically if you can.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Devere are 'fairly' easy to beat at POPLA but you need help to write a specific appeal for that stage.. I have one I wrote before so can help you later on.
In fact, AFAIK Devere don't use debt collectors so I would wait for the Notice to keeper before doing anything.
Please show us a picture of the sign on site, all wording, while you wait for the NTK. And do NOT reply to any private messages about this matter unless it's from a regular like me or Stroma, someone with many thousands of posts to their name ONLY. Devere read 'their' forum threads (so what Devere, you are still going down!).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

These companies use bullying tactics to scare you. It will not get to court if you follow the process outlined above. If you have to go to the POPLA stage you are certain to win. Forum regulars will tell you that so far the rate of success at POPLA using a forum helped appeal is 100%. Firstly, don't worry. These are not penalty notices as issued by the police and council appointed wardens. They ony have the authority to issue thoughs. You have received an invoice disguised as a penalty notice, over an alleged breach of contract between the driver and the landowner.
Of course, the whole thing is built on sand and can easily be beat by doing your homework on-line. Use the correct wording and this should get past PoPLA adjudication as they will not have a genuine pre-estimate of loss.
Doing nothing is sadly an option, as these parasites want paying come rain or shine.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0 -

If you really feel this is too much for you, then there's always the Parking Ticket Appeals Service (Google it) ... for a £16 payment* they'll handle everything; if they lose they pay the cost of the PCN - all you pay is £16 for their service, win or lose.
(I am not affiliated with them in any way. It is a service run by a couple of the regulars here at MSE).
* There's another scheme that charges slightly less than this, but that scheme is actually run by a parking company. If you find the service charging less than £16 then you have the wrong one.0 -

They can't touch you after you win at POPLA! I have just helped someone on another forum to write a winning POPLA appeal about Devere and their signs were not well worded so 'no genuine pre-estimate of loss' (as in all our templates & examples) wins the day. Can we just see the sign please, that's all? Then it's downhill all the way after that with a simple 2 stage appeal we will help you to win.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
