PPI reclaiming trading as company-advice needed

Hi all
Hope someone can help.
I entered into a contract with PPI claim company, this company was a Ltd company trading under a particular name and has ceased to trade under this name, however I have been repeatedly contacted by another 'trading as name 'of this Ltd company saying they have taken over. I didn't know who they were so told them to get lost and refused to sign any new permission forms for them, they seemed to go away.
But they are now hassling me and I have recently received an offer from Britannia out of the blue so they are demanding money from it.
I don't want anything to do with them.
I can give them the money they want but they didn't do anything after the initial letter sent by the original company.
Am I under contract to this company now trading under a different name?

    Maybe.

    It depends whether your contract was actually with the parent company (and they have lots of trading names) or whether it was with a subsidiary.

    It also depends whether it was the company (i.e. trading name) you signed with who are/were authorised by the Ministry of Justice, or whether it is the parent company.

    Ultimately, any company can make a "commercial decision" to stop using a certain name - but if your obligations are to the parent company, you will - most probably - still have those obligations.

    The contract I signed says 'the company Ltd trading as Yet Another Company'. It was Yet Another Company I thought I was dealing with.
    Obviously not those names!! ;)
    The new company doesn't say they are part of the parent company and has a different company number. They state they have acquired the claim investigation from the parent company, however from a search of the Internet people have stated that the new company is a trading name for the parent company!
    Hope this is clearer!

    If you put the company you originally singer with, into here, does it show as a trading name of the parent company or as it's own company?

    If it shows as a trading name, I think you may have to honour the contract. If it shows as it's own company (and if you put the parent company it, it comes up separately and with a different CRM) then I think you're ok and have no enforceable agreement with any third party now.

    This is just my opinion - I think it's correct, from my experience, but please don't take it as gospel.

    Wow now I am confused!!
    Ok I put in original claim company, it came up as trading name of parent company but both have surrendered their authorisation before any offer was made to me.
    I have put in new company name and it is not showing as trading name or linked business to original parent company but is authorised.
    I do note that the address is the same and directors are also the same!

    On the original agreement you signed, there would have been a registration number, a CRM number - which is the authorisation number the Ministry of Justice gives to the company?

    What is the number on your agreement? If it's "CRM: 31333", then I think your agreement is probably valid and you'll have to honour it. If it's another number, then you probably don't.

    Hi,

    Copied and pasted from MOJ website(apologies as rather long)


    As a result of an investigation, the Claims Management Regulator has decided to suspend and vary Cerys-Angharad Limited’s authorisation to provide claims management services under the Compensation Act 2006 with effect from 17 January 2014.

    The additional conditions are:

    1. Cerys-Angharad Limited will not complete direct marketing by telephone to obtain potential clients for regulated claims management activities.

    2. Cerys-Angharad Limited will not instruct a third party to complete direct marketing by telephone to obtain potential clients for regulated claims management activities on its behalf...................

    Please note the effect of this action was stayed by the First-Tier (Claims Management Services) Tribunal on 22 January 2014 until 20 March 2014 when the business withdrew its appeal. On the same date Cerys-Angharad Limited surrendered its authorisation.

    Edited as in hindsight all information was unnecessary

    I know.

    But Ifonic Plc are authorised on their own - link below (as well as Ifonic Claims being a trading name of Cerys-Angharad Limited. So, it depends on the CRM number on your agreement (I think).
