draft of complaint letter to bpa

I would appreciate it if you would proof read the enclosed and advise if I've messed up on any legal of the legal stuff


Dear Sir
I am writing to register a complaint against VCS who claim to be members of your organization and as such are supposed to abide by your agreed code of practice.
As the registered keeper of the vehicle noted above I attempted to implement the appeal procedure in accord with VCS's terms and conditions.
I have enclosed a copy of their letter to me which clearly demonstrates their flagrant abuse of your code of practice .

For your information I have listed their abuse of your code of practice below

Asking a registered keeper to enter into further correspondence to obtain a POPLA code

Failing to supply a correct and valid POPLA code within the rejection correspondence

Appearing to indicate that the issue of a POPLA code is conditional on the details of the driver of the vehicle being supplied

Given VCS' s obvious abuse of your code of practice and flagrant abuse of the terms and conditions of their membership of the BPA I would like to know exactly what disciplinary procedures will be implemented to prevent such unlawful and unsanctioned behavior being continued.
Such behavior demonstrates VCS' s total disregard for your organization and begs the question as to whether they should be allowed to remain as members.
If the BPA fail to act on the information provided, which from evidence in the public domain is clearly not as isolated incident, then the credibility of the BPA and its existence as an independent body must be questioned.

I intend to forward a copy of the above letter to my local MP and the DVLA.

I await your reply with interest.

    Don't hold your breath waiting for a sensible reply from the BPA Ltd.

    Expect some rubbish about them driving up standards within the profession but having no powers to do anything about any problem.

    Anyway, according to the BPA Ltd the behaviour of their members described above is perfectly acceptable.

    The British parking association limited is a trade association set up to furhter its memebrs interests.
    in other words they probably coudnt give a toss about your complaint, as long as it does not or will not have any effect on their memebrs ability to continue to fleece to public and con them out of their hard earned cash.
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"

    I don't expect the BPA to respond in anyway that may be considered positive.
    The reason for writing is because I told VCS that I would hoping that they would cancel the PCNK instead of having to go through POPLA etc as I'm not confident about constructing a water tight appeal due to my lack of knowledge etc

    There are examples on this forum showing how to construct a successful POPLA appeal. Once you get your code, please post your draft on here and people will help to make sure it's a strong appeal.

    Regarding your OP, the one sentence I would add to this (and to any other complaint) is something like: 'Please can you ensure that my complaint is counted in your official statistics'.

    You could always write to your mp after getting brush off from BPA - that's what I've done. Still awaiting his reply.

    Maybe we should encourage everyone to do that after theyve won their case at popla or court. Change our tactics and ramp up the presuure like some of the ppcs have done.

    Except that the BPA ltd. still believes that PPC's day-to-day running expenses (which have to be paid even if nobody breaks their "rules) can be counted as "losses". With a mind-set like that, you have no chance .

    Patrick Troy will file your letter in the dustbin as he is convinced the BPA/PPcs are whiter than white. :eek:
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    We need to ramp up the pressure to get these organisations to comply with current regulations. MSE doesn't like forum members using terms like cowboys etc but in my experience I would say that's exactly what they are!
    My practice manager was approached recently by a rep from VCS to get us to sign up to their scheme.The car parking space outside our practice is council owned, he told her that it didn't matter as it was civil law that would be applied etc
    Forum members will clearly understand that the PCN will be unenforceable but will all the pensioners that visit….no they will just pay up due to the fear factor etc yep cowboys for sure!
