Council Planning Department Tolerance .. Does this exist?

    Ive just sent an email to my Consultant informing him of this .. Now to see what he comes back with !!

    Just spoke with my Consultant.

    The building is seen as not being within the curtilage of my property and therefore seen as not being permitted development.

    Consultant said just sending the application for Lawful Development is not enough, and has to be accompanied by the document saying that the land has now been transferred to me.

    Oh Happy Days :(

    Looks like you should have waited until the land was actually yours.

    I would carefully take down the blockwork you have put up and clean off the mortar ready for the blocks to be reused once you own said land.

    Yep .... Which is why (going back to my original question) i'm hoping I will be granted a bit more time to obtain the transfer document.

    Planning Officer didn't say to take the structure down, he just said it would be in my best interest to stop the building works.

    Surely by the time they can take any enforcement action the land will be yours anyway so problem solved?

    Well you said the land is likely to be yours in four weeks. What can they do between now and then? How can they make you remove it?

    This still does not make sense. Why are the planners even interested if it would (except for the ownership issue) fall under permitted development.

    Isn't the issue that the shed is not within the curtilage of the house? The planner seems to be suggesting that would not be a problem if you were building it nearer to your house. Permitted development probably does not apply outside the curtilage and I don't think the ownership of the land is the problem.
