wrong "offence"

hi everyone.
I rehearse in a studio that has a private car park and notoriously nippy private wardens. I stuck my visitors ticket in the window but unbeknown to me it fell onto the cars floor.
I got a £50 penatly notice but on closer inspection the offence on the ticket read "parked in a disabled bay not displaying a blue badge" which I absolutely wasn't. I rang the company to chance my arm and they said the offence code was irrelevant as I wasn't displaying a ticket, any thoughts on an avenue of attack.

Wait till the NtK. Hopefully they might have pictures. If not, then deny the offence in your appeal and demand photographic evidence.
Hopefully, they will shoot themselves in the foot.
Use a standard soft appeal but begin the appeal by saying
"The driver denies the charge and refutes that he parked in a disbled bay"... then the standard "No GPEOL, no contract, unfair charge etc......"0 -
You do know this is not a real parking ticket but a scam one ?Be happy...;)0

Tbh I am a driving instructor and haven't had any sort of ticket in 10 years and am finding so much great info here. I think I will print off the standard letter and going from there. Thanks for your help.

Older readers may remember PC Savage from "Not The Nine O'clock News". He invented "offences" such as "Treading on the cracks in the pavement", "Urinating in a public convenience." and "Wearing a loud shirt in a built up area during the hours of darkness."
Whatever is written on the ticket is irrelevant as, like PC Savage's made up "offences", there is no legal basis to the charge. Unless it is a hire/lease car wait for the Notice to Keeper in the post.
And read the sticky at the top of the page in the meantime.Je suis Charlie0 -
It's not an offence for gods sake, this is a private parking ticket, and the person on the phone was right, it is irrelevant as these companies make it up as they go along! Now please tell us what company and whether this is England or Wales ?

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

The ticket was issued in England and the company are Sussex Security Solutions trading as Parking Enforcement

Oh yes we know about that lot. LOL, ex clampers of little brain, apparently! Please promise us you will tell your learners about never paying a private parking ticket?! Your job means you can spread the word about 'no GPEOL' and other winning appeal points that beat the scam. And you can tell the new learners the difference between a PCN (Penalty charge notice = Council) and PCN (parking charge notice = scumbag).
I think that firm may be with the IPC so it won't be POPLA as your independent appeal stage, if I am right. Check out the BPA and IPC 'AOS lists' to find them and then read the 'right' Code of Practice to spot where they fail.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
