Moving To Switzerland During Bankruptcy

What affect if any would moving to Switzerland have on any Bankruptcy in the UK. I have a high chance of a job offer coming from Geneva so how will it affect the BR?

    Hi there,

    Moving abroad should not have any major effects on your bankruptcy as long as your Official Receiver (OR) or Trustee can comminucate with you. You are obliged to keep them updated with any changes to your circumstances.

    Under a bankruptcy you may have to contribute into an income payment agreement (IPA), it could be more tricky if you are overseas for the OR.

    Also, check with your potential employer that going bankrupt won't have any issues with the job.

  • If you are bankrupt then you are bankrupt whether you have an IPA or not. The IPA is just the agreement you make to pay excess disposable income to the OR for a period of three years.
    The only reason that you wouldn't be able to pay an IPA is if you don't have excess income left after your agreed costs of living.

    Hi thank you for that. I am just wondering how the court could decide on this if I was being paid in Swiss Francs and living outside of EU law?
  • I'm pretty sure that they could work out a conversion rate.....it's not as if you're being paid in camels.

    A quick call to your local ORs office might shine some light on the question.

    However if I just didn't pay, there is little they can do about it right?
  • If you refuse to cooperate with your OR they can apply for a BRu/ BRO or even worse they can go to court and get your discharge from bankruptcy suspended indefinitely! I think I would rather cooperate than be an undischarged bankrupt forever but maybe that's just me!

    I appreciate that which is why I am asking to find out what happens. But the whole point of leaving these shores and my kids behind is so that I can support them like a real father rather than have to give all my money to the courts which is why I am trying to figure out what will happen.

    Not a good example to give your children really,sorry I think its best to face up to it and deal with the situation not run away.

    My children have suffered enough. I suspect I will have no money left in my budget for an IPA judging by my SOA anyway but I do not want to risk it. I have spent 3 years living without stuff that many take for granted, a lot due to my own stupidity in the past but I feel like I have already paid the ultimate price in losing my marriage, my kids and all worldly possesions to have that extended a further 3 years is just too much to take. Its easier just to disappear, in my head at least anyway.
