Building regulations nightmare.

  • Spoke to my solicitor today. It appears the seller knows nothing about this wall apart from approximately when it was built. He's no idea weather it has planning and building regs. Nor does he know who built it.

    My solicitor had cancelled the local authority searches so not to incur a cost if we pulled out.

    All the vendors solicitors have been saying is "see what the searches reveal" and "a structural survey will reveal what you need to know". This sort of implies that NOBODY knows anything about this wall and it's certification and therefore searches and a survey is the only way to progress.

    So my two options are -

    Pay £600 for a full structural survey and £130 for searches.

    Or

    Walk away with a 50+vat solicitors fee and start the house hunting again.

    My only concern about the first option is if we have the survey and searches and find that it hasn't got building regs and/or isn't safe and the vendor isn't willing to sort it out.

    Can I ask for assurance from the vendor that if such issues arise that he will sort it out? If so do I need this in writing?

    You can ask for whatever assurances you want but they will be worthless as nothing is binding until exchange of contracts. The vendor could still pull out and you would have wasted survey money.
