It's good that you read & checked it all - but paragraph 10 is 'one for the future' as it talks about IF in future any statutory laws get passed then the info required of that law would have to be included as well (if that makes sense). So basically there is nothing yet re paragraph 10.

I would be surprised if a green & white letter from PCS 'identifies the creditor' (using that word) though, for example, or repeats clearly the words from Schedule 4 warning the keeper about liability?

As I am at work I can't convert those links for you so another poster will help to convert them in a mo, I expect!

Delete your links as we can see your personal photos on that flickr account I think.

Anyway I had a look at the NTK and look, if you compare it to Schedule 4 paragraph 8:

    - it doesn't identify the creditor does it? Doesn't use that word and it's very important seeing as the letter doesn't even come from CP Plus at all, it talks about 'their client' and asks for payment to be made to PCS (so who is the creditor, could be CP Plus, could be PCS, could be Debt Recovery Plus, could be the landowner, could be an occupier of the land, could be another party...).

    - also it doesn't ID the location, what's GR Chieveley, that's not a location really?

    - was this at a train station?

    - was the original ticket a PENALTY Charge Notice or a PARKING Charge Notice (important as CP Plus issue both types)?

Make sure your appeal gives them all the refs they need - don't miss stuff out - but doesn't state who was driving (i.e. we hope you wrote it as the keeper).

Thanks, I have removed the links, although there isn't much on my Flickr account.

I am away for the weekend now so will check the new bits out on Tuesday, the location was a service station and no I have not offered any information on who was the driver at the time.

    Thanks for your input.

A service station is better as it won't have been a 'penalty' charge (only railway ones are for CP Plus!). So wait for the rejection letter and insist on POPLA if a code/form is not provided.

It is indeed a "Parking Notice".

I await their next response and will sit tight until then.

    Thanks.

So last Friday we received a new letter from PCS on behalf of CP Plus, with the usual "Liable" etc etc written all over it, no POPLA as requested, so I thought here we go again, more follow up to do and send off.

Then Saturday morning another letter dropped through the letterbox regarding my recent communications and that the parking charge had been cancelled with the sub text of "on this occasion only" lol

Anyway, thanks to the newbies sticky another successful result.
