    Yes she did thank you we did not know they had a fund she has rregular contact with her McMillan nurse will get her to enquire about it

    Being threatened with eviction and actually receiving the court papers are two very different things. As has already been mentioned if you haven't had the court papers already then it's scare tactics, and they appear to have worked.

    We have received a letter saying they are applying to the courts but not had court papers

    In a situation like this it is a sensible thing to sit down with your mum and work out exactly what half the costs of living together works out to.

    So you would be responsible for half the rent (including the arrears), half the council tax, half the utilities bills etc etc.

    In fact, since you have two children you should be paying more than half.

    The fact is that you are an adult living with another adult and therefore should share the costs, rather than considering yourself to be a kind of lodger.

    If you were not living there your mum would no doubt be getting some HB and CT reduction. At the moment she is not entitled to this because of your non dependent deductions being taken into account for both HB and CT.

    The rent arrears are your responsibility too. (not legally, but morally)

    The reason they are talking about a Possession order is because your mum has reneged on a payment plan that was set up.

    To prevent this going to court and occurring more costs you need to talk to the HA and pay the arrears. They might only accept one payment for the lot or perhaps two payments. Having reneged on the payment plan I doubt whether they would accept another one. CAB may be able to help you negotiate but you must stick to any agreement made. Rent arrears are a priority debt.

    CAB could also help you both do an income and expenditure sheet so that savings could be made.

    I am not trying to be judgemental but you are both working the same hours and might even be receiving about the same pay. However, you are receiving CB and tax credits which probably give you a healthier income.

    Please sit down and work everything out properly. It may be that you are paying your fair share. In which case your mum may need some budgeting help.

    Given that this is an immediate family member, I'd say that it really ought to be more "from each according to their means" than any predefined split. ESPECIALLY when there's illness and serious arrears.

    OP - a trip over to the debt forums should see you get seriously useful help with the budgeting and prioritising.

    Correct me if I am wrong
    - you probably earn about 5k
    - you probably receive 12.7k in tax credits
    - you probably receive 2.3k in child benefit

    None of this is taxable.

    You take home 1750 per month.

    Even the raised contributions you are paying account for just 23pc of net salary. Most people end up paying at least a third, up to 50pc if you are a young single renter in the south east.

    I appreciate you may have specific costs we don't know about, but you theoretically should easily be able to put 170pm and solve this very quickly.

    You are getting an amazing deal on housing given you occupy most of the property and pay peanuts. Perhaps you will just get given a property and more benefits to pay for it if you end up homeless, but my priority would be to preserve the home you like rather than end up with the uncertainty of a council allocation.
