£400 in the grand scheme of things isn't a huge sum. The whole lot needs to be paid off before it gets to court. Although your mother could claim mitigation by having been so ill and therefore treated with leniency by the court.0

Because she didn't tell me she was going to have trouble paying it I already give her £100 a week plus pay her phone bill and the gas and electric and her bus pass to get to work and back but I also have 2 young boys to pay for as well as my own credit commitments

How much is the rent?
They can threaten eviction, but IMHO there would be no point going to court with only £480 due, and a tenant being able to tell the judge that she was in hospital for cancer and that she shares the dwelling with 2 young children. It's likely a scare tactic at the moment.
However, of course arrears should not continue to accrue and all efforts should be made to clear them.0 -

I moved back in with my mum to escape an abusive relationship and we originally agreed on £85 a week all things inclusive so I am helping out as much as I can but my children are my main priority. And £400 might not be a large sum off money to some people but to us it is a lot off money we don't claim benefits apart from my tax credits and child benefit we both work for a living we don't have fancy tv's, don't own a computer or any fancy gadgets pretty much everything we own is second hand. We spend our money wisely we don't splurge.0

And also no extra arrears are accruing but because she made one payment 2 days late they are threatening eviction.0

Would you be entitled to any benefits? The rent arrears came about when she was recently rreceiving treatment for cancer and the sick pay did not cover the bills but she wasn't entitled to any extra benefits. The arrears only amount to 430 pounds and I am not on the tenancy so actually although she is technically intentionally homeless I am not because the rent is not my responsibility and they are not allowed to place me in a hostel because off my children this much I have managed to find out for myself but everywhere I try to find info it's a grey area
Did your mum have a Macmillan nurse? If so contact them asap. They have a fund where you can apply for a grant in exactly these situations if you face hardship while undergoing treatment for cancer. We did this for my mum and they helped us financially.0 -
The only way I could claim housing benefit and council tax reduction would be if the tenancy was in my name but the housing association won't allow me to take over the tenancy because it is classed as trying to gain extra benefits and increasing the benefit bill. My mum gets a 15% reduction in council tax for having me living here but when I moved and she reported the change in circumstances to the housing benefit because of my income and the fact I give her board means she isn't eligible for housing benefit0
