As the RK of a car purported to have parked overhanging outside a marked bay in a private car park near a station I have received a letter (which I initially took to be from PPS, as it has their logo large on the top right). I took this to be a NtK, following the purported issue of a windscreen ticket, and replied using the PPC appeal template in the newbies sticky thread. I also pointed out that as the 'NtK' was received well outside the 56 day limit and there were a number of other errors in relation to POFA2012, I was under no obligation as the RK.
On closer reading of various threads about PPS and the 'NtK' I realise that I should have appealed the initial windscreen ticket as RK and that the 'NtK' is in fact from CCS and not PPS. The only reference to CCS is a small reference number prefixed 'ccs'. I sent my 'appeal' to what turns out to be CCS's address. There was no reference to POPLA or POFA2012
Now it seems to me that my options are now:
1) Ignore everything from now on as I have no liability under POFA2012. - This may result in CCS giving up or they might take it all the way to CC resulting in much hassle for me (although I would win the time involved of defending this would far outway the £130(!!) being demanded!)
2) Complain to BPA and DVLA as PPS have not followed the guidelines, meantime continue to ignore CCS.
3) Send new appeal to PPS's address in attempt to get POPLA code. - unlikely to happen from what I've read? They'll say too late to appeal.
Obviously the ideal solution is to get a POPLA code so that I can win an appeal using the usual points, primarily not a genuine estimate of loss.
Can PPS simply ignore BPA guidelines and I then have to argue the toss with them? I have enough on my plate at the moment without having to deal with dross like them and have no intention of giving them a penny.
What do the experts here suggest as the best course of action,? I am going to be very busy soon moving into a new house and want to keep other distractions to a minimum!

Have a look at lollyhugz thread about P4Parking/Nighthawk as hers is an example of how a couple of email complaints to the BPA about this behaviour, can get a PCN cancelled. I would not ignore it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have not heard back from CCS yet ( 'appeal' was sent about 10 days ago). Do you think I should wait for a reply from them or just go straight to BPA/DVLA?0 -
I sent CCS a robust appeal/response to their 'NTK' and they closed the account, so it is worth doing.
I am still going through the motions of BPA complaints for breach of the Code of Practice to see what happens next.
An appeal to PPS will probably see them say that you have missed the POPLA window (not true) and that they have passed it to debt collection and you will have to deal with them only from now on......0 -
I agree with C-m about not ignoring and complaining to the BPA and DVLA. I would send the complaints now.
Personally, in addition, I would also send a copy of the original appeal you sent to CCS to PPS as well with a covering letter regarding the ambiguity of the letter - the prominence of their logo in comparison with that of their agents etc and that you are taking this to be a non compliant Notice to Keeper therefore for the avoidance of doubt your appeal has been submitted to both their agent and themselves.
Also state that their breach of BPA CoP has been reported to the BPA/DVLA0 -

Yep - it certainly is.
Seems they use every trick in the book and a few more besides.
The parking companies really should complain to the adhesive manufacturers judging by how many windscreen notices only seem to stick long enough for a photograph to be taken of it on the car.
And I'm sure the postal service must have it in for them given how much mail seems to go astray to and from PPC's. :shocked:
Mind you - it's not all bad - the profits of the "scary" red ink suppliers are soaring

I would complain now to the BPA and DVLA, because we know it'll take them 'time to investigate' even though they have only just investigated TNC's shenanigans re P4Parking!

You have grounds for complain because there was no NTK sent (believe us, there wasn't) and you are aware from your research that TNC do this all the time and have already been told their 'letter' is incorrect, and that ''the BPA have had discussions with them and they have agreed to amend in line with POFA and this in now in the process of being done.''
So you expect this PCN to be cancelled (as keeper you are not liable) since yours is the same situation as others that the BPA have recently investigated regarding TNC's actions for P4Parking (remind them your PPC is Premier Parking Solutions who are implicated by allowing this to take place against the BPA CoP). Insist that TNC cannot be allowed to continue sending a scary demand instead of anything resembling a POFA 2012 compliant NTK and that PPS and P4Parking should receive sanctions for not bothering to ensure their 'debt collector' even has a NTK letter in its repertoire of drivel. Remind the BPA (use these words) that this sort of sharp practice by TNC and breach of the CoP by PPS and others, is not an example of AOS members 'driving up standards' in this so-called industry.
