Following a PCN I received back in December 2013, which I consequently ignored and later received NTK 6 weeks later from the PPC, which again, I ignored. Several letters have since followed from DRP chasing payment. I ignored them all bar the last one which arrived a few weeks ago following advice i've read on the Newbies Forum. I replied to DRP, copying in the PPC using the template letter from the Newbies Forum that begins:

"I confirm receipt of your letters dated X/X/XX,XX/X/XX, X/X/XX in relation to an alleged debt appertaining to an unpaid parkingcharge from PPC.

Firstly, any liability to pay this debt is vigorously disputed as the legalenforceability has not been established and suggest that you refer the matterback to your client.....etc, etc, etc".

I have had a response to this letter from DRP and the first paragrapgh reads:
"Internet Templates:
I must stress that simply sending in standard template responses, most likely obtained from the internet, will not resolve the matter. In addition, I would recommend that professional legal advice be sought on this matter as an alternative"

The letter continues to state that "As per the BPA code of practice, point 22.7, the driver/keeper/hirer was allowed 28 days from the date the PCN was issued and/or 28 days from the date the NTK was sent to challenge the PCN. The time to challenge the charge has now expireded and therefore access to the IAS (POPLA) is no longer available" - DENYING ME MY POPLA CODE.

The letter goes on to explain the breakdown of the charges, what will happen if I do not pay what I owe etc, etc. They have also said that:

"Although any correspondence that does not provide further evidence will be noted and retained, I cannot guarantee that we will reply to it".

Has anyone else had one of these letters from DRP and how did they respond? Any help from what I do from here would be very, very gratefully received.

Thank you all.

Of course we've had these letters, it's the typical trash template reply from a typical trashy company. They complain about having template letters sent too them but they send out tens of thousands of template letters, pretty ironic really.

You are safe to ignore these [TEXT DELETED BY FORUM TEAM]. Have you complained to the retailer involved yet ?

  • Dear Stroma,
Thank you so much for replying so quickly! I'm impressed - thanks!

I am starting to get a bit concerned about these letters from DRP so thought I had better seek some advice on here. I haven't complained to the retailer yet, no. What if they retailer is not the landowner? The car park belongs to a very small shop.

If I complain to them, what should I say?

    Thanks again

Which PPC are we talking about here ?

DRP are members of the BPA as well as PPCs - none of them like the internet forums.....

You are pretty safe with them, they haven't issued any claims in the 6 months to March 2014, and only once for the 12 months previous to that, so 1 claim in 18 months out of thousands of tickets.

  • Stroma,

That's pretty reassuring, thank you, but what do I do now? Just ignore DRP's letter (and future letters) or write to the retailer?

You are a bit late for a POPLA code - although if this ever got to court, we can advise on how to try again for POPLA .

As you have ignored until now, probably best to save yourself the cost of stamps replying.

But do please come back if you get a genuine LBCC or Northampton court papers.

I would make complaints to the retailer, use email instead of writing if you can, if they are a large company you could look to see if they have a Facebook or twitter presence and make complaints there.

What a shame you missed the golden ticket of POPLA appeal. We changed the advice here over a year ago. No-one should ignore these.

So concentrate on a complaint to the shop Manager for starters and/or the landowner, including as Stroma says, using facebook and Twitter if applicable.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
