PCN issued by APCOA at Luton Airport

Options
Apologies if i am doing this wrong as this is the first time i am using a Forum.

I received a PCN for my vehicle at 3 am at Luton Airport this month. The driver took the wrong lane and stopped at the barrier to the entrance for vip parking and not the short term parking. His passenger jumped out of the car and the driver simply reversed out and left. The driver did not notice the signs apparently showing terms and conditions. They have issued a £80 charge which is reduced to £40 if paid within 14 days. This is unfair as the driver would not have done this on purpose if they had known that there would be charges. The driver had stopped at the barrier and was not even blocking the road or causing obstruction to traffic. Any advice would be appreciated.

What advice did you find out from reading other threads about APCOA at Luton?

What advice did you get from reading the 'newbies' sticky thread at the top of the parking forum?

What advice are the majority of other new users getting asking the SAME questions?

Welcome to the forum, I see you are new so:

Please start again at square one and don't pass 'go' until you've read the 'PRIVATE PARKING TICKET? NEWBIES PLEASE READ THIS FIRST!' thread at the top, which you may have seen already but which gives you your first appeal wording (doesn't matter about the circumstances):

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

Please read the top thread and learn how to appeal. We have 100% record of winning appeals at POPLA stage, for over a year now. This is NOT a fine so take the advice we know works. There is no fine so no increase. You'll win at POPLA.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Thank you coupon-mad. I will follow the instructions and keep ou updated on my progress.
  • Hi, I got a response from POPLA today and they have stated that APCOA have cancelled the pcn. This was after they rejected my first appeal. Thank you for your help coupon mad and I think what you people are doing is a great service.

We seem to be missing quite a bit of what happened but congratulations anyway ....
The word "gullible" isn't in the dictionary
    Tickets: 19 [cancelled: 18, paid: 0, pending: 1]
    PPC Appeals: 8 [accepted: 2, rejected: 5, pending: 1]
    POPLA: 4 [accepted: 4, rejected: 0, pending: 0]
  • Sorry i should have expanded on what happened.
I first sent off an appeal letter to APCOA explaining what i stated at the start of this thread. They replied back about a week later and stated that the were rejecting my appeal and that i should have seen the signs.
They supplied a POPLA code and i emailed POPLA with a challenge email using a template on the newbies thread. I was a bit worried at the time realising that if i lost the challenge then i would have to pay £80 instead of £40.
I got a response back from POPLA via email a few days ago stating that APCOA were cancelling the PCN, but did not give a reason as to why they were doing this.

Overall i can't stand these people, i don't mind paying a parking ticket if it is justified, in this case i feel as though everyone is out to make a quick buck.

Thanks again to you guys for your help and i hope others find this useful.

Well done Qwerty - they know defeat when it's staring them in the eye, although if pushed they will probably say it was cancelled 'due to an administrative error'.

Don't matter much - you won!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
