    What are the repercussions of this?

    As the owner of a business you should be fully aware of the difference in protection rules on transactions between businesses and those subject to consumer protection.

    You tenants have no contract or relationship to the fridge supplier, so cannot make any claim against them.

    Any claim they make would be against you, and you could then claim against your supplier. Not sure either would succeed though.... it sounds like you have done the best you can to sort out the problem for them.

    Is a private landlord a business though? I vaguely remember this being a very grey area.

    That aside, the purchase of the fridge would still be covered by SoGA.

    I think Bris is right. The vast majority of the UK now has fairly easy access to 24/7 supermarkets. It seems a bit strange they have spent a lot of money to put food in something that hasn't arrived yet.
  • This is a shared house, so it is mainly people who are on a bit of a budget. Buying in bulk is a good way to save money. That said, being a shared house there it's also a limited amount of fridge space per person, so they can't buy that much. They are only a few minutes walk from several shops/supermarkets.

    Having lived like that 10 years ago I don't understand the buying in bulk bit. Think about it, I take it you mean Supermarket promotions? Supermarkets have things like BOGOF or 3 for 2's which isn't bulk. You can't walk into a Supermarket and say if I buy 20 of these what discount can I get, they're not a wholesaler.

    You don't need to buy "bulk" to save money, just buy the offers one at any one time or failing that buy the value/basic/smart price goods.

    Not that I'm suggesting you shouldn't replace the fridge, because that would be good practice, but it's just something to bear in mind should your tenants become awkward.

    If a fridge is supplied with the house it has to be maintained.. most houses aren't supplied with one.

    When something is on a particularly good offer, you stock up as you don't know when (or if) it will be at the same good price again.

    Why not ring a local 2nd hand white goods supplier and ask them for a price to store the food for a few days?

    Or ask a local butcher for a price?

    Do you have contents insurance for the property? Does it cover a broken freezer's contents?

    Tell them to ask a neighbour and see if they have space?

    Sounds like a B2B contract to me, you own the property and get a sum of money for it's use. Therefore IMO it's a business. Do you pay Tax on the earnings you get from it? I rent a house out and have to pay tax on it, if it is in London, you will be over the threshold for no tax.


    That being said, if they want compensation, you have to decide if you want to honour it ( I wouldn't) , then put a claim in to the supplier for the same. The supplier owes the tenants nothing, the contract is with you. They were foolish buying a large amount of food, with the likelihood that the delivery didn't take place.


    The above is my opinion, if any of the legal odd bods on here want to state different, then that's fine, just giving my 'two penneth'
