Whether it was a supersession or an appeal, it was lodged in March 2013 so it would apply from at least that date.

Mr Chicken, you will have a letter from tribunal, it will say on that letter

"The decision of (insert date) is set aside you are entitled to ESA with the Support Component."

Your arrears will be back to that date.

Unless you were on ESA C in WRAG with a protected rate of about £110 then SG would not pay you any more than that so no arrears would be due.
The problem with this scenario is that you would only be in WRAG C for 365 days so your WRAG C would have ended in May 2012 or 365 days after it started whichever is the later, then you would have moved onto WRAG IR and SG arrears would be payable.

Here's an update, on Tuesday I took in a letter of complaint to the local jobcentre where a nice lady emailed it off to ESA and also told me my wife would get a call by 3.30pm that day which she did, basically the ESA told my wife she still had to be assessed by ATOS who were so backlogged which is why it has been so long though the ESA said they would try and push for my wife to be assessed asap, not holding out much hope on the speedy response from ATOS.

Saw MP today who is going to enquire why the process is going to slow with the DWP

Finally got an ATOS assessment appointment, all down to the MP's letter, my wife's benefit will cease before any decision is made by the DWP as 365 days is up mid September.

Wife had WCA today, seen by a doctor who said he would carry out a physical after asking questions but in the end said he did not need to carry out a physical examination, does anyone know why the doc changed his mind on the physical ?

Found out via my local council that my wife has been put in the support group for 3 years, I would like to thank my MP for his help in pushing the DWP to do a WCA on my wife and I believe without his intervention we would still be waiting for it. I would also like to thank the kind posts from members of this forum.
I think my wife's case just shows don't give up and fight for your rights.
