Forgot to mention something that my ex withheld from the csa all them years ago too.She started working but refrained from telling them that, which would have made a diff to the workings out done by csa.
I really hope the new system is better for all those needy parents with care out there & also in the respect of parents without care, so that they don't get any nasty surprizes when they are rebuilding their lives with new partners & families etc

The CSA don't allow you to move on and rebuild your life!
Sound bitter towards the CSA? - that's because I am, they are ruining my partners and my life together.I can only please one person per day.Today is not your day.Tomorrow doesn't look too good either.0 -
Yes agreed, but in general most people want extras taken off their income like their house insurance or loans that they have taken out which cannot under any circumstances be taken into consideration. The law does stipulate what is and what is not allowed though, so there will of course be mistakes when something hasn't been allowed when it should have been and vice versa but I am saying that we cannot just override the law to make a customer happy - it should be within the legislation. If not, then they have the right of appeal which is why it is there in the first place to ensure that the law is upheld.0

Totally agree kelloggs. Thanks for continuing to contribute to my post

There is nothing to stop you from making a formal complaint. Why don't you ask to see somebody to discuss the case Face to Face? You can ask how the arrears came about when they returned overpayments to you and discuss your concerns with them. Push hard for it though as they are apparently trying to disuade people from having Face to Face meetings for some reason. Take notes and then when it is over, think about whether you agree with what was said.0

In respect of your ex with-holding information; it is not an offence to fail to report a change in circumstances to the CSA, however, if they ask you if you have had any changes, then it is an offence to refuse to tell them or to give false info. In your case, she has done nothing wrong in not telling them of her change in circumstances. It is still the same under CS2 - if an NRP receives a huge pay rise, there is nothing in law which says that they must report that change. If later on, the CSA write and ask for his up to date infom then he must provide it. Any new assessment which would be affected by the increase in earnings will only be done from then and not backdated.0

I sent the following letter to the csa data protection team, which they received on the 19th of july & they have confirmed this. They have 40 days (around 27th/28/th august) to provide me with csa clerical records & csa system records for my dispute.
In the meantime I have been issued a deductions from earnings order which i received today stating money will be taken from my wages from this thursday on a weekly basis (9/8/07). Can they really please themselves what they do these people, even after i wrote the letter below. The money they are taking off me will really cripple me because only a couple of months ago i took hp for a new car, not that they seem bothered. any help would be appreciated but i am guessing I am goosed..

Dear sir or madam,
I have just been contacted with ref outstanding child maintenance. As no evidence has been produced as to why I still have such an outstanding balance, or as to how it is all worked out, I request you send me the following.
Please send me the information to which I am entitled to under section 7(1) of the Data Protection Act 1998. I request all computer and clerical records to which I am entitled, and would ask that the notepad sections of the computer files are dated.
If you need further information from me, or a fee, please let me know as soon as possible.
I would like to add that I received an overpayment from CSA sometime around 1997/98 & am therefore wondering why I received it & then was made to pay more money after receiving this. I also understand the ANC TEAM 4 at your Kirkcaldy office are dealing with this case & therefore I request you keep them informed of all developments in this case, so they do not pursue legal proceedings against me, without myself & any legal representatives of mine first having a chance to peruse & or act on any information provided as per the above act.
If you do not normally handle these requests for your organisation, please pass this letter to your Data Protection Officer or another appropriate official.
Yours faithfully0 -
I would suggest you edit your post to remove the personal info such as the reference number!!!!! Have you asked for a Face to Face yet?0

I wanted to see what response I received to this post before i phoned them up with ref to the deduction order etc but thanks for reminding me, I will request that by phone tomorrow & thanks for telling me about personal info, it totally slipped my mind0
