Anything can happen inside the strange world of P Eye's offices aka Chorley Towers
I got an email cancelling a PCN from them and 5 days letter a rejection letter with a POPLA code turned up for the same PCN number - so I appealed it anyway to cost them the £27 smackers0 -
Perhaps 1 more point with regards to the signage and the fact it has now changed - Shall I add "at the time of the alleged parking event" or similar to the paragraph about non-complaint signage?
Since the POPLA appeal is a one-off opportunity, I'd like to ensure that there won't be any recourse to PE to provide new photos/info about the new signs with their data pack. I will not be able to refute those after the appeal...
What do you guys think?
NC0 -
Worthwhile adding but be careful to word it from the registered keepers perspective - maybe adding something like that you aware the signage has recently changed at the location and you put P Eye to strict proof proof that any evidence they submit in rebuttal of your challenge must be shown to be of the signs in place at the time of the alleged event.
Do you have any photos of what the signs were like before they changed?
If you do a Search of the Forum for the particular MSE you may find another OP who might have some for that location
p.s. Although your appeal is a one off opportunity you can submit additional evidence at anytime up to the hearing - useful if/when you receive P E's evidence pack as you can raise additional points to POPLA regarding the evidence they supply0 -
Yes, valid point about wording. I do not have any photos, I'm afraid... Will search through the forum though.0

OK, appeal lodged. Awaiting confirmation and date...0

Hi there,
A quick update and a question...
So my appeal has been scheduled, and is due in a few days. I've had nothing back from POPLA with regards to the other party's defence and/or evidence yet. Is that forthcoming?
Have tried logging into the appeal using the code provided but that's now not recognised. Emailed POPLA and am awaiting a response.
Just wondering what to expect in this regard...
Thanks!

at the moment they tend to send nothing in , in which case you win by default I would think (many others have done , check the POPLA DECISIONS thread)
so no news is good news0 -
Well, as others have pointed out, it appears that PE have not lodged any evidence or other supporting docs, so my appeal has been allowed! :T
Here is the full transcript:
NC11 (Appellant) -v-
ParkingEye Ltd (Operator)
PARKING ON PRIVATE LAND APPEALS
PO Box 70748 London EC1P 1SN 0845 207 7700 enquiries@popla.org.uk https://www.popla.org.uk
Reference 6061144032 always quote in any communication with POPLA

The Operator issued parking charge notice number 123456/654321 arising out of a presence on private land, of a vehicle with registration mark NC11NCC.
The Appellant appealed against liability for the parking charge. The Assessor has considered the evidence of both parties and has
determined that the appeal be allowed.
The Assessor’s reasons are as set out.
The Operator should now cancel the parking charge notice forthwith.
Parking on Private Land Appeals is administered by the Transport and Environment Committee of London Councils Calls to Parking on Private Land Appeals may be recorded
Reasons for the Assessor’s Determination
It is the Appellant’s case that the parking charge notice was issued incorrectly.
The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
Accordingly I have no option but to allow the appeal.
Assessor
So once this has been upheld, I'd assume it also covers the other PCN's I have received. Surely PE would not want to lose again...
So all in all - success!
Thanks everyone.

Nice one OP
Did you get 4 POPLA codes too? We’ve had to remove your signature because your opinion differs from ours. Please check the Forum Rules if you’re unsure why you can not have your own opinion on here and, if still unsure, email forumteam@moneysavingexpert.com0 -
So once this has been upheld, I'd assume it also covers the other PCN's I have received. Surely PE would not want to lose again...
NOOOOOO!
Each PCN has to have a separate POPLA code and an individual appeal sent to POPLA. Obviously use the exact same appeal (provided all PCNs were from the same location and in similar circumstances).
Don't go to sleep on this one! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
