If Lloyds acted unfairly and you can prove this to them then they should be able and willing to contact CIFAS and get the marker removed. File a formal complaint with them (Lloyds) explaining why they got it wrong....
  • Also, having this problem but the advice posted is really helpful. Thanks!

Given the timeframe that has past since this was placed it is unlikely that they can hide behind tipping off or on-going investigations excuses for non disclosure.

Raise a formal complaint for the closing of the account and the placing of the marker ask them to explain their reasons for this action.

If you are not happy with their reasoning ask for it to be removed and if they won't pursue the complaint further.

Yesterday I raised a complaint with Lloyds on phone, they said they would call me again to take some more info. Today they called me a few times. They told me that they have removed the CIFAS marker and that they will write to the credit reference agencies to remove the 'default' from my file. Also they will give me some compensation for the inconvenience.
Now, can I call Halifax also, and ask them why they closed my account, or if they could review it again and re-open it? Can I go to any other bank to open an account?

Thanks a lot for all the comments from the bottom of my heart. They really were very helpful.

Surely you can ask them to review/reconsider. It's worth getting something in writing from Lloyds first and enclosing a copy.

Pleased to hear this is in the process of getting sorted out.

When the CIFAS marker has been removed, credit files updated and something in writing from Lloyds it is worth approaching Halifax to see if they will reinstate your account.

As you used it as a business account you did break their terms and conditions so they may be unwilling to do this. You will need to convince them that you have or will have a business account somewhere to process business transactions.

If the Halifax won't change their mind then again once the CIFAS marker has been removed and credit files updated you should be able to open both personal and business bank accounts elsewhere.

Make sure you are happy with the Lloyds written communication and compensation offer before accepting it.

I talked to Halifax, they said they couldn't reinstate my account, probably because I was using it for my business. A few days ago I applied for Co-operative cash minder account, today I received a letter saying that the account couldn't be opened. I don't understand why. Is there any other database apart from CIFAS that could be holding any negative information about me?

Have you checked that your credit files had been updated?

I have only checked on Equifax, but there was nothing there in the first place. Should I check with Experian as well?

Yes as co op use experian as main agency, you need to be sure that all three cra have updated to ensure your files are clear, the cash minder account is a basic account so only fraud markers (ie cifas) or bankruptcy as a reason not to open account
