ANPR have replied after I sent them a letter - help!

Apologies as this might be a bit long.

I received a windscreen PCN after parking on double yellows in an area known as Spinningfields in Manchester City Centre, I was parked on "Left Bank" M3 3ER. Several other cars were also parked there & I saw no obvious signs deterring me from parking there. I was gone for 10 minutes. The PCN states that I had breeched because I "was parked without a valid permit on display" "parked in an area that should be kept clear at all times" "no stopping - no permit" was also written.

I ignored the PCN and waited for the letters to arrive after reading the advice from the newbies thread. I received the Outstanding Parking Notice on day 43, the Final Demand on day 57, so I sent a revised copy of the template letter on the newbies thread saying "your signage was not seen by the driver".

Whilst waiting for a reply, I received a Notice of Intent, ordering me to pay £140, and saying they will pass to a debt collection agency if it isnt paid.

I then received a reply to my letter yesterday and now I'm not sure what to do. I expected a threat of court.

N. Martin begins by explaining what the numbers and letters mean on the PCN. He then goes on to explain what the generic definition of the infringement means - all jargon to me, I presume to scare me into paying.

he says "furthermore, before I made contact with the issuing officer, I actually contacted the proprietor asking them were they happy with our service, I can honestly report that the signs in their opinion are "sufficient and bound to be seen" which in effect means that they comply with the BPA Code of Practice."

"in light of the above, perhaps you will understand why the PCN has been issued, and although I really do sympathise, I must stress that we are contracted by the landowner to enforce the terms and conditions that are stated on the signage. In conclusion we would suggest that you may wish to re-consider your claim to appeal, as this would nullify any discounts that remain and (should you lose) may incur further costs. if you still feel that you have a valid case to appeal, please write to us again and we will provide you with full details for the Independant Appeals Service (POPLA)"

Now what do I do?
I havent complained to Spinningfields yet? should I?

Any help would be greatly appreciated!

    More lies from the mythical N. Martin. Yet more evidence of ANPR's continual breaching of the BPA Ltd Code of Practice in not sending out a POPLA code with the rejection of the appeal. I wonder how many sanction points they get for this offence? It must be a negative number considering the number of times they have been reported to the BPA Ltd & yet they still haven't reached the 12 points required for suspension.

    In conclusion we would suggest that you may wish to re-consider your claim to appeal, as this would nullify any discounts that remain and (should you lose) may incur further costs.

    1. You don't want to reconsider your claim to appeal.
    2. Ignore the 'lure' of discounts (even 'Early Bird' ones :rotfl:).
    3. You won't lose.
    4. You won't incur further costs by going to POPLA - they will - @ £27 a pop!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes I saw this the other day.

    From reading all the ANPR related stuff, I feel confident regarding my appeal, the guy sounds like a right one, however how do I go about getting a POPLA code now?

    Should I write back stating that I don't want to reconsider my claim to appeal, that I will be taking this further with POPLA?

    Write back saying that if Clever Trevor wasn't such a moron he'd realise he's just broken the BPA CoP by not automatically issuing a POPLA code. Demand they give you your POPLA code or else !

    ANPR Ltd threads are funny as hell, sorry OP I'm not making light of your situation, but Trevor Whitehouse (owner) is a laughing stock of not only us but his peers in the parking (non) industry.

    Have a look on google for him, he's also the inventor of the clamp that he can't ever use, the inventor of ANPR-in-a-box that was forced to take down advertising on the site, his claims of catching shop lifters and terrorists are just some of the claims.

    Ole Trev the clamp is just a very long winded and boring bloke who must drive anyone who must put up with him nuts. He brings entertainment here though when people learn about him
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I have read about him already, and know N Martin is made up. From reading your comments on other peoples posts, I gathered that he's a joke, just want to make sure I'm going about all this the right way :)
