I've been overpaid in two jobs. I refused to pay one of them back once for awhile (I'd already left the company by then) and it all went quiet, next thing I knew I had debt collector letters come through the door.
That was for a mere £97. Don't think they will let £3500 go that easily. They are entitled to it back if they can prove it was an overpayment. They should, however, work with you to accept it back in instalments.0 -
got a day off soon and will go to citizens advice about this,will obviously come to a meeting at work etc to sort this out,but one thing that really annoyed me was my managers threat of fraud & disciplinary action against me if it esculates,which i have noted

just feel if they have my signature on a contract stating that i agree to 40hrs with wage drop then i trust them to pay me the wage im entilted to & then hit me with this and expect me to back down and just pay up0

Go direct to whoever is in control of the money and talk to them if I were youDon't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -

I'd take the £100 a month approach, too.

If I had a sudden, 'out of the blue' demand for £3.5K my attitude would be confrontational (in the first instance) too!

You will also have paid extra Tax and NI on this £3,500 as well. So they will need to make sure that they square this up with HMRC.
In reality, 20% of £3500 = £700 and NI @ 11% = £385. So you should get a Tax/NI rebate of £1,085 back.
That takes the sting off the pay-back.
I would also stop working more than 40 hours a week. If that causes them problems, then offer to work extra hours for an overtime rate of 1.33x hourly rate.
And in future CHECK YOUR PAYSLIPS EVERY WEEK. If you were to ever get laid-off, then you would need to provide the DWP with at least 1 months worth of wage slips to get your benefits and "I can't access my wage slips as I can't remember the username and password" isn't a valid excuse.Never Knowingly Understood.
