hi,my work has said they have been overpaying me for 3 years and say they want it back all £3500 !!!! i only check my wage through my bank account and my wages fluctuate monthly up & down with bonus etc,to be honest i dont think im paid enough for my job & did not know anything about this,it happened with changing hours from 44 to 40hrs and they said ive been getting paid for 44,funny how its took so long for them to notice this & i already have a signed contract dropping from 44 hrs to 40 hrs with wage drop,i feel they are trying to make me the scapegoat for someone elses mistake & i refused to allow them to start taking the money back, whats my options here people ?:mad::mad::mad:
they will have a signed contract from me agreeing to go from 44 hrs to 40hrs with the wage cut,so how can i be at blame for their mistake im furious and feel very stressed about this,i think they have a cheek trying to get me to pay this back

Im always checking my wage slips to see ive been paid for the hours worked inc OT. You sould have noticed it sooner, they can ask for it back though, if you can't afford it in 1 go maybe see if you can spread it over a number of months. You could if you wanted make a case for being paid the extra.0

If they underpaid you in the same manner would you expect it back considering it would have been your error in not checking?
I suggest you read up on estopple but I would not be hopefuly and would suggest you look at negotiating as long a payback period as possible.
Though ask for their exact calculations on payment, breakdown month by motnh if possibleDon't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
im employed for 40hrs and do at least 44 every week anyway and dont get paid overtime,so i could say check all the hours i worked over and not been paid for & i want paid for that over the last 3 years yes ?0

we can check our wage online through a site you log into with username and password and ive logged in once over the 3 years as i dont remember the log in details,i expect my work not to make a big error like this and expect me to pay it all back,im going to citizens advice with this0

Though, it would be up to you to prove those extra hours worked if they hadn't been paid.
Check your contract, if in a union ask them for help.
Otherwise, negotiate in a calm manner and mention the extra you do for the company.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
You could also post on redundancyforum.co.uk who has a retired lawyer and might be able to help. Her advice is blunt though.Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0

Is this all adjusted for tax and NI?0

ive refused anyway as they want way to much back a month than i can afford, its making it very awkward for me at work now and its obviously going to esculate,im going to fight this as i feel im the victim in this & feel very unfairly treated by my work which ive gave at least 14 years service to0

Hence, negotiate (as they should be).
