G24 now Debt recovery?

Hi need urgent advice please my wife received by post a fine for parking in a B&M Carpark from G24 (she spent £180 with them that day!) she contacted them and they said it should be waived, we now hav a letter from DRP ltd asking for £150! Parking charge date was 05/10/13 what do we do? She actually couldn't physically get off the said carpark that day due to traffic problems too! What can i do - can i appeal??

Well, Simon, technically Mrs S didn't spend £180 with G24 whose income is entirely from motorists.
You need to do 3 things.
1. Read coupon-mad's sticky NEWBIES thread at the top of this forum
2. Get back to B&M in person, demand to see the manager and armed with your receipt and story about them having agreed to get it cancelled, get him to get back on to G24 to get the ticket cancelled. Of course, if this was a retail park and B&M was just one shop, they may not have the clout to do that.
3. Using the information in the NEWBIES thread, get an appeal into G24. You have missed POPLA, I am afraid, but still appeal.
You must work on the assumption that G24 won't cancel the ticket until you get from them in writing that they have.
But read that sticky !!!!!!!!!!!0 -
Firstly send an email to DRP ( I'm guessing G24 must have changed their debt collectors ) saying that the debt is denied and that they must return it to their client. Point out that no further correspondence will be entered into with them and should they contact you again it will be considered harassment.
Then send the following to G24 :
Dear G24,
This is an appeal against the charge issued to the vehicle with the registration XXXXXX, charge reference XXXX.
It is the registered keepers assertion that :
1. The charge is not a genuine pre-estimate of loss.
2. The signage does not conform to the BPA CoP to which G24 has committed.
3. G24 has no authority to issue charges over the land in question.
4. You have failed to adhere to your promise that the charge had been cancelled.
As such the charge is rejected. You should now either cancel said charge or provide a POPLA code for the registered keeper to appeal to the independent adjudicator.
Any further correspondence other than confirmation of cancellation or a POPLA code will be considered harassment and could result in legal action being taken against you.

Hi Hot Bring, I followed the advise laid down in the sticky and sent the formatted letter stating i wasn't the driver gave my wifes details and stated in letter:
"Please note: this discharges my obligation as Registered Keeper under PoFA 2012 and any court proceedings will be defended on that basis."
Just received a letter from G24 now saying my period of appeal has expired and that i have a number of options to 'choose' i.e. court action or pay. What can i do now do i send the aforementioned email to the debt recovery and letter to G24?0 -

1. You are the RK ?
2. You responded to the NtK late but named your wife as the driver and also gave a serviceable address ?

Hi thanks for response yes i am registered keeper, I responded to G24 stating my wife was driver and giving a serviceable address, no my wife has received nothing the letter is addressed to me.0

OK, send the following letter / email :
Dear G24,
Re : PCN xxxxxx, for registration XXXXXX
As the registered keeper for the above vehicle I have dispensed with my responsibilities by providing you with the drivers name and address for the incident you claim has lost you money. As such any further correspondence can be treated as harassment and could result in legal action against you.
As per the BPA Code of Practice ( as well as POFA ), once the driver is named the ONLY party you can chase is the driver. You will now be reported to the BPA for breaking the CoP with a request to issue sanction points against you. You will also be reported to the DVLA with a request that your access to their database be suspended.
Your options now consist of the following :
1. Stop sending any letters and demands.
2. Provide the Registered Keeper with a POPLA code.
3. Write to the driver named with details on how they can appeal.
4. Ask Adrian King to pop over to London Zoo to select a few more employees from the monkey cage.
Any further correspondence to the Registered Keeper will be ignored.

Hi I have emailed the debt recovery as advised, but just noticed on latest G24 letter to me that they stated:
'unfortunately your period of appeal has expired as explained on the back of your contractual parking charge notice'
Is this a viable claim they have made or just crap?0
