Searches not submitted

Can a solicitor not submit searches until they have received draft contracts from the vendors solicitors? We paid for our searches 2 weeks ago and they still haven't been applied for.

They can, provided they have sufficient information, but once submitted the searches must be paid for, and you'd lose that money of the sale did not then go ahead.
The solicitors probably have a set order that they do things in - you could always ask them, and if you want the searches sent off early, then you can specifically instruct them to do that.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
What information would they need to submit them if they didnt have the contact?0

You might want to hold on until the contract, mortgage, your sol and survey are all in place. But you can instruct to have searches done now but you would loose the money should your mortgage get turned down, or the valuation or survey flag up issues.0

The solicitor won't submit without the contract confirming which land parcels are for sale. It's not as simple as saying I'm buying 123 Oak Street as he needs to ensure that the correct property is identified and all surrounding land that may come with it.

Mortgage offer is in place and survey and valuation has been carried out. We have done all our bit so just need the solicitor to submit the searches so we can get things moving.0 -

I had an offer accepted, EA got their solicitor to send me a quote - quote had the wrong address on it. While being built the house was referred to as "Plot X" then ended up with a different door number, "No Y". Quote came through for "No X".
Solicitor needs to know for sure what you're buying, what you think you're buying, what people think they're selling, before searches can have the address written on.0 -
My solicitor apologised for being a bit tardy with the searches because he hadn't received "the property boundary map" from the vendor's solicitors - vital apparently.
When he had received it, the searches took just over 2 weeks and they are huge. Never seen searches before, didn't realise just how thorough the process was!0 -

Our solicitor has done the draft contract which we have signed and sent back to the with the f&f form. Just frustrated that we are still waiting for the searches to be done. Apparently they are only taking around 5 days to come back so thats something.0
