T-Mobile Contract with it's dealers

Does anybody know anything about the contract that T-Mobile has with it's dealers?

I know that when you take out a contract, that is with the dealer rather than the network but what I want to know is:

If the customer can satisfy T-Monile that the dealer is in breach of contract (For example not delivering the SIM and not being able to replace it in a reasonable period of time), has T-Mobile then got the authority to nullify the contract and refund the customer? Then.....is the dealer precluded from charging the customer's credit card for the full 12 months?

    where did you get your phone from?

    You sure the contract with the dealer?

    I would assume so. I bought it from the dealers website so I'm pretty sure the contract is with them, especially as it's cashback. The charged me for a few months and I didn't even have a SIM.

    T-mobile cancelled the contract and gave me a refund plus compensation. Now the dealer has charged the remainder of the year to my credit card

    The mobile phone contract is with the network, not the retailer.

    Only larger companies like Carphone warehouse operate their own airtime providers/billing companies and this is generally on O2 and Vodafone.
    T-Mobile do not operate in this way so the contract as a customer is with them, the retailer is merely the means of introducing you to them as a customer.
    The cash back part of the deal is provided by the retailer and they are responsible for this part.

    Who was it your bought from?
    And what do they say in their terms and conditions?

    I would say that You need to challenge this charge with your credit card company because as far as I know they have no right to charge your card in this way.

    Vodafone dumped cpw last year. You won't get any new Vodafone contracts or service through them.

    The dealer is saying that although T-Mobile cancelled the contract, they had no right to do this as my contract was with them not T-Mobile.

    They say that if T-Mobile cancelled the contract and didn't point out my liabilities, then they have acted irresponsibly.

    Oh.....and because I returned the phone to T-Mobile rather than to the dealer, that's theft!
