I'm not sure about any advice that's been given so far.

What case have you opened in Paypal? I would simply have gone for "item not received" as whatever way it's dressed up by the seller you haven't received anything.

The seller has no proof of delivery and appears to just be stalling. Why accept half the money back when you have not been at fault? Ask for a refund in full of all monies paid.

Sending back an empty envelope, tracked or not is a foolish thing to do, not to mention a waste of money. A simple picture of the packaging would have been enough for any genuine seller.

Is there an obligation to use the same packaging to return a package as the seller used to send it?

I doubt it. Given he sent you "air" and this was SNAD according to your dispute, I would be tempted to send back "air" tracked using signed for second class delivery (the cheapest option).

There's no proof to say the seller is scamming he didn't send tracked, the envelope open etc. Its people on here like you that are the scammers

Take his 50% offer and move on, its only a fiver. If he wanted to scam you he'd offer nothing as you've missed deadlines and not sent tracked etc

I haven't missed the Paypal deadline, only Ebays. No, I didn't send it tracked but I've his written confirmation he received the empty packaging back - surely that proves I sent it?

Not for E bay, no tracking number = no refund.

The buyer hasn't received anything, tracking backwards and forwards in this case is irrelevant. Also if the buyer or seller says they have received it in a message or feedback then Ebay/Paypal will look at that. It might not always work automatically as tracking but would work in an appeal. I've had it a couple of times with buyers who complained about an item and then claimed non receipt, one of whom was daft enough to list the item for sale on Ebay (he no longer has that Ebay account!).

  • I'm sure there is (or at least was) an option on Paypal claims to say you received an empty package.

Best advice is to phone Paypal, explain the situation and see what they say.

Good god, its a tenner in total... Have you no regard for the price of your time?

Put it behind you and move on, these things happen.

If I send you my Paypal address can you send me a tenner please? I'll pay the fee so it won't cost you anything;)

RFW, the buyer has opened a SNAD, so she cannot change it to an INR.

As lunatic said, there used to be an option on Paypal to show you had received an empty package, but I haven't opened a case for such a long time I wouldn't know if it is still there.

The buyer has used Paypal, who are not nearly so flexible as Ebay, so it really will mean returns tracking or nothing.
