Dell dont understand Sales of Good Act

I bought a Dell Dimension 5100 in August 2005, and through the live time of the system i contacted dell more times to try to get the computer fixed.

Anyway back last year i was promised a refund so i got the computer, monitor, speakers and printer ready to go back to dell after a couple of months i grew concerned and contacted dell again to be told there was no record. At the same time i told the rep as of this date both problems are still unresolved. The rep who promised the refund was Praveen P or something similar and it was on 25/26 of July 06. The reason why the first contact about this issue until december was I studying for a HND in Computing and i was under the assumion that dell could carry out the action with out being baby sitted through it. Today i received a phone call not from Customser Relations that i was promised but by Technicaian Support. Anyway this person was very rude and didnt listen to what i had to say any way before he rudely hung up i discussed to him about Trading Standards, and the Sales of Good Act and that a vebal contact is just as legally blinding or how else are dell going to take telephone orders. I also stated that i would be contacting my Credit Card Company as Section 75 of the Credit Card Act allows me to action a Charge Back. I have given dell far too long to sort this matter out. So Buyer Beware Never Buy a Crap PC i mean Dell :mad: . I am just hoping that the Customer Advocate From Dell, Inc will read this post and pass my comments onto each other.

  • Dave go troll somewhere else, the OP said that within 1st year both Dell and himself agreed on the refund. I would think it would be better if you read all the posts correctly and fully because posting your comments of trolling.

    OP, yes you do have a legal right as Dell said and agreed to give you a rrefund its not your fault that Dell are stupid and the customer support is base in another country that does not understand UK law.

    The law still states that you have upto 6 years. And since they did promise me a refund in the first year legally it is a contact.

    Take them.

    Either write to Dell or your credit card company recorded delivery with one of the following letters:

    Dell
    Credit Card Co

    Give them seven days to send you a cheque. If they don't send this letter (again recorded). If you still don't get a refund, put a claim into the Small Claims Court at this web site. You will get your money back.

    First of all thanks to RichyRich for good advise and links. Update Dell HQ in the UK stated that they will honor the refund. However they stated on the 12July that the system would be collected on the 16July and confirmed this again several times. The 16th came and when and the system was not collected when i contacted them they stated that it was a preferred date and that it may not be collected. So why even ask for a date when the lazy and lairing scum of a courer they use dont come or even phone. I told them there and then that i will be including a bill for storage of the system that they or their courer can pay. the Dell rep continue to state that they didnt have connect with their courer (ofcourse the Tooth Fairy or the little birdy tells their courer). So !!!!ed off at dell the most lazy checky stupid and crap computer company.

    I would suggest giving them 14 days at least. The letter will just go around Dell for the first couple of days after receipt.

    Hey Optimist you misunderstand. Dell Millbanke House has confirmed and is going to issue the refund however its the collection of the system dell are messing up. As of today the courer came stated that the system was to be in boxes however dell stated that the courer will come with boxes.
