Just to reiterate as some people <naming no names> skim read my original post
Currys have offered me a credit note to the value of £115 which I can spend in their store only on an oven which is no longer available, thus forcing us to buy one for £199.99.
We originally paid on the card for the oven.

As you have accepted the refund on a credit note, you will be in a much harder place to negotiate.
You can try, but they are within their rights to offer instead a reduced cash refund (as was mentioned above, the £115 is generous).
In addition, it doesn't read like you have held up your end of the SoGA - have you presented Curry's with an independent report to say that the product is inherently faulty? If not, they don't actually have to do anything for you until you do...
Just worth bearing in mind before you rock the boat!

If they won't budge on the credit note (which, as they have mailed it to you, they have assumed you have accepted as a remedy) and if you don't want to buy another oven from them then you could always sell it on eBay. Someone is bound to do a Buy It Now for, say, £100. Still pretty good for something that is, even if only just, out of warranty and well beyond the 6 month period where they have to accept the fault is inherent.
Ps - the ones JL are selling have a 2 year warranty!0 -

Under the SoGA you are entitled to a refund, less a deduction for the use you've had. Your refund should be in whatever manner you originally paid, so presumably cash.
You can agree to take a credit note if you want, but I'd insist on a better offer if so.
I think Currys have been generous in this situation.
If the OP asks for a refund minus any use, Currys could quite easily turn around and ask the OP to provide an independent report to show the cooker was inherently faulty.0 -
If I get an independent report on the fault (which I actually offered to do for Currys) then once the fault is found to be with the manufacturer, they have to pay for that report I believe?
I am more than confident that the fault is theirs. We haven't been warming clothes in it or trying to roast small people in there. It has been looked after and cleaned regularly.
I think we'll try and flog it on eBay anyway as we have to get rid now and I hate sending things to the dump. It's most probably a faulty element which someone can repair easily enough.

I agree with the others in that I think the offer Currys have given you is perfectly reasonable.
The amount of time a product is guaranteed by other retailers is irrelevant IMO - maybe that's why it is more expensive to buy from them? In this instance, it really is a case of you get what you pay for.0 -

It is a Logik built in single oven for £115
They also have two cheaper, one at £99, one at £110 and a further 9 models all less the £199. Maybe you looked in the wrong place when searching for a replacement if you couldn't find any below £199.

My suggestion was to flog the credit note on ebay, but if you still have the oven then you could sell both!0
