CPM ntk issue

i received a ntk about my vehicle which was parked up on a side road.
it was on the 22-03-14 at 2am and in the letter it said for the alleged contravention of "unauthorised parking".

me and a friend stopped on the side road to go get some food from the local burger place on the corner, my friend went and i was in the vehicle. i only was there for less then 12mins max.

they have included two photos-
1) the back of the vehicle with the no. plate
2) the back of the vehicle with a warning notice on the wall to all drivers.

now my issue is, is this legal.

1) can i be issued with a pcn via the post, i thought the only people that can do this is the police or the local council.
2)they have issued this at 2am where theres no cars no obstuctions.is this right.
3)in the ntk they have got the colour of the vehicle wrong.
4)theres no picture of the front of the vehicle otherwise they would have seen me in the vehicle or vice versa.

i thought that any parking offence needs to be sent to the vehicle keeper within 14 days of the offence and it been over that period.

i dont know whether to pay the £100 fine or not.

ive read other posts and most of the reply was not to pay because cpm like to use scare tactics, that there scammers and its not legal.

what can i do????????

    You appear to have missed the advice and templates which were under your nose right here on the parking forum all the time. Please start again at square one and don't pass 'go' until you've read the 'NEWBIES PLEASE READ THIS FIRST!' thread at the top:

    I would stick with the tried and tested wording for the simple 2 stage appeal. At POPLA stage we win every time, 100% record, so follow the NEWBIES thread including how to win at POPLA in due course and you'll be fine, just like all these newbies were:

    None of your questions are really relevant to this situation as it's not a real Council PCN or anything so, yes they can issue it. when they have done, with the pics they have done. And yes, you can beat it; please read the top thread and submit the usual first appeal (do not alter it).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    1) is this a public road or a private road ?
    2) depends on the restrictions imposed and also number 1) above
    3) irrelevant
    4) depends if this is an anpr picture or one taken by a warden

    pofa 2012 can be invoked if timescales are met, but that only makes the RK liable, doesnt stop a pcn being issued

    yes a private pcn can be issued by post, thousands are every week

    its not a fine unless a judge or court imposed it, sounds like a parking invoice to me, it wont say the word FINE anywhere on the paperwork

    CPM tend to issue tickets on private land, so in effect it sounds like you were trespassing

    only a court can decide if its legal or not
  • i ve seen alot of other people parking there to get food from the burger bar i spoke to a friend and he says hes parked there b4.

    i think it could be a private road not sure.

    basically its a no through road behind shops.

    but my issue is can this be right especially at 2am.

    there was no obstruction i wasnt illegally parked and i was in the vehicle at the time.

    if its a private road or private land, then you were trespassing

    that is the issue you are dealing with, and the rules placed there by the PPC or the landowner , so it doesnt matter what has happened before or to others

    treat it as a normal private parking invoice as per the NEWBIES thread

    If we are to help, then you need to answer the questions that experts here ask, not the mitigation you seem to want to give.

    Now this is not being harsh, it's just that there are lots of posts on here and we all just give up some spare time to help. But if an OP doesn't co-operate, we move on to someone else's problems.

    So, give the answers that are asked for and the most important first one is "Was this on a private road or a public road?" If you don't know, then find out.

    The second point is you should read the NEWBIES sticky thread at the top of the forum to get a feel of how this needs to be treated.

    The third is what is the date of the NtK?

    Help us - we help you, that's the deal.
  • It's a access road for shop keeper so I suppose yes it would be a private road.
    The ntk invoice date was 17/4/14 I received on 22/4/14, the actuall date of contravention was 22/3/14.

    OK.

    Then you need to follow the advice in the NEWBIES sticky and the flowchart contained therein.

    Simple appeal to PPC using standard template appeal with the aim of getting a POPLA code. Then you use the POPLA template to win at POPLA.

    This is just a very brief outline of all the information contained in the NEWBIES sticky.

    Please follow the wording of the appeals and don't worry about the actual details or assumed injustice of the ticket. Save your energies for the two appeals you will be making and do follow the templates.

    If you don't you will lose, I promise you.

    Hi guys just a quick update, I sent a letter to cpm on the 24/4/14 and I still ain't had a reply back regarding the ntk also requested a popla code
