Without giving us more details, were pretty stumped, could you not give us the story using a scenario of the case, without actually naming or shaming, you could always call the company "X".

I am in dispute with a company who.... are accusing me of lying and stealing. Is there anything I can do about that?

Er, get a grip, perhaps? :rotfl:

Mickknipfler, as you will have gathered by the less the helpful comments on your thread, we have pet trolls who enjoy winding up people on the vent boards. You're probably best not to post any more details on here unless you want more unhelpful comments. As a couple of posters have advised, libel is a very complex and expensive activity. Even if you win, you could end up bankrupt. That doesn't mean false allegations are not actionable, whether spoken (slander) or written (libel), but so much turns on the context of the reply. For instance, there is a world of difference between saying "you are a thief" and "I think you are a thief" and "you appear to be a thief to me". All are insulting if you're not a thief, but have quite different meanings depending on the context in which they appear. Politicians excel at this kind of phraselogy, making words seem something that often mean different things to different people. One course of action open to you is to "invest" £100 or so, getting a consultation with a lawyer or practice who can give you some unbiaised advice. Even then, if they say you have "a good case" I would think long & hard before pursuing any action, because, as I said at the start, you could end up bankrupt even if you win. I think it'd be much better to get the CC/ breach of contract sorted, then, pursue the company for the alleged slur in the light of winning the CC case. An apology and a goodwill payment would be a very good outcome compared with doing a Jonathan Aitkin "scales of justice". Sorry about the length of the post, but hopefully some of its helpful.

You are obviously very distressed about what has happened. Hope you resolve your issue soon.

Thanks chaps....don't worry about the trolls everywhere.

They haven't actually called me a liar in as many words. Rather "you have far more to gain by stating that this wasn't received, than we do by stating it was"and "you have effectively stolen from us" and "In simple terms this is theft."

    hmm...
ok am curious on this one.

sounds like a "we delivered a package to you, which you say you did not receive, but we have records to prove we sent it but which to you are not admitting receipt of this although we know you received it and therefore we are down money as you will not pay for receiving said package which you said you did not receive and therefore we are losing out on both package and money".

    Hmm.
well, they didn't say it outright though? From your above post more like it's implied that they are stating fact rather than saying outright "you are a thief" but implying that whatever you've done/not done is somewhat dishonest.

It was a mobile phone. The phone came but there was no SIM card. They swear blind there was and think they know better than me whether it was there or not. Why on earth they think I want to say the SIM wasn't delivered if it was beats me.

Eventually the network stepped in and cancelled the contract, sendin me a bag to return the phone. The dealer's comments about theft apply to me sending the phone to a third party and not back to them (even though they refused to accept it back).

In Scotland there doesn't have to be a third party, in England, there does...
