Smart Parking - Asda - Disabled Bay

I am new to this site, however I have researched this site fully over the last few hours and I understand that I have received an unenforceable parking (not fine) but 'invoice'.
Earlier today I went with my 6month old daughter to Asda, it was extremely busy and despite driving up and down the parent and child parking bays there were none vacant. I then parked in a disabled bay at the front of Asda as there were about 10 vacant. I did this for 2 reasons.
1) It was either that or park in a tight normal bay and scratch somebodys car whilst removing my child strapped into the baby cradle car chair
AND
2) It was raining, so I could have parked 100metres away from the shop in a normal space without a car next to it and completey soaked my young daughter
What should I do in this instance, as I get the feeling Smart Parking will not enforce this? On the contrary I know that mitigating circutances are not taken into account?
Should I appeal to Smart Parking? (or does this mean I am admitting the offence)
Should I appeal to Asda CEO?
Should I ignore letters that come through my door? (If they ever materialise)
Should I go back to Asda and photograph the area where there is 1 tiny sign nowhere near where I was parked, way above head height that states that I may recive a penalty notice failing to display blue badge?
Thanks in advance!

clearly you havent read the newbies sticky thread at the top of this forum, especially the flow chart in post #9
everything you need to know is in there
as for those bays, you should not park in them - period , no matter what the circumstances are regarding the weather or not wanting your car scratched
those bays are provided by law (the EA 2010 act) for people like me , not you, and nobody who is not disabled or doesnt have a protected characteristic (like me) should park there (doesnt matter if there is one bay or one hundred bays) , hence the reason you correctly got a ticket
the bay would have a wheelchair or other signage , so you dont actually need any signs telling you not to use them - its been blatantly obvious for over 20 years on both public and private land , especially since the DDA 1995 act never mind the EA 2010 act
if you win this after the NTK arrives, you should donate some money to a disabled charity as pennance0 -
at no point have you indicated in post #1 that you are registered disabled, so my reply to you treated you as one who does not qualify under the EA 2010 and those people make my blood boil due to their selfish attitudes, hence my reply
ps: your reply above is obnoxious and offensive and will be reported to the forum admins due to your personal attack on me0 -
Er, so if you are disabled why the story about the child?0

If this OP had said that they were in some way disabled but without a Blue Badge and had parked in an Asda's 'disabled' bay and got a ticket, then we would all be falling over ourselves to help.
But ..........0 -
It's simply impolite to park in a disabled space if you don't qualify just as it is impolite to park in a parent & toddler bay without the required child. Of course if there are plenty if empty bays available for those who do qualify then there isn't really a problem is there? We are here to help those who are bullied & harassed by PPCs with their unwarranted parking charges not to bully & harass posters who may have not parked politely. We must be consistent in identifying the real villains here. Parking charges for breaching made up rules about disabled spaces are just as wrong as those for overstaying or parking outside a marked bay & we should help those motorists who have incurred them.0

Agree in general, but not when a new poster writes this to a decent contributor "You are obviously an out of work, undersexed hermit and in need of a little less narcissism if all you do is get off on replying to strangers on this site."0 -
Oh dear, I seem to have missed the drama here. And posts have been deleted, but I get the gist from GD's quote.
Never mind, I'm sure there'll be a new one, of similar ilk, along before too long!
Pity the OP has alienated most, as we could have really helped her sort this out. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I despise PPC's with a passion. However, I'm afraid I don't believe the OP's post for one simple reason. They state they parked in the disabled bay for two reasons. If disabled, the first of these would have been I am disabled but had forgotten my blue badge.
I half killed myself today walking right across a car park as I'd forgotten my badge, and I'm 99.9% certain I could have escaped any ticket without too much fuss.
A complete description of circumstances is essential if we're going to be able to help properly.
If the OP is still reading and doesn't want to hang around here, go to Pepipoo and they'll help you. :beer:If you want proper advice, please consult a legal professional. I am not one! Thanks.0
