Parking fine at Robin Retail Park Wigan

Hi there I'm new to the forums but after getting a parking fine last week I've been looking through a lot of posts trying to get some advice.Anyway last week I went into Next as stupidly parked in a parent and child space when I didn't have my kids with me.I was only in their a few mins whilst returning a parcel so the parking attendant must have seen me go into the shop alone and then slapped the ticket on my car.

Anyway the company on the ticket is CM services LTD and it's says they are an approved IPC operator.Now I know from friends who have previously been given tickets by various companies that the companies have to be registered to a certain organisation and if they're not then they don't have a leg to stand on.

From what I can see though this company is registered but in not entirely sure.Now I know if the companies genuine that they can apply to the DVLA to send a notice to keeper after a certain amount of time and then you have no choice whether to pay unless you appeal which there's no point me going down that route as i did park illegally.But if they're not genuine then they can't possibly get the details from DVLA hence will not even no who I am or here I love.So I suppose what I need to no is this company genuine and can they get my details from DVLA? As if they are I would rater just pay the £60 now as opposed to £100 in a few weeks time,so if anyone can help if be most grateful!

    Comment - you did NOT receive a "fine". You received a speculative invoice.

    Step #1 - read the NEWBIES sticky thread.

    Step #2 - if this was a windscreen ticket (and the car is not a company/lease/hire car) then wait for the postal notice (Notice to Keeper)

    Step #3 - when the postal notice arrives, send the appeal template from the NEWBIES thread.

    Step #4 - search this forum for IPC and/or CMS to find related threads. (Stick to threads started within the last 6 months).

    And the "attendant" did not mitigate their "losses" by having a word with you as you left your car. This point was brought up at a court case which the parking company (VCS) lost.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • Hi yes so I'm assuming now you've said wait for the notice to keeper that these people are actually genuine then? Only because I don't think of have a leg to stand on appealing this and it says that you have 21 days to appeal it on the ticket and it may take 2 months for the notice to keeper to come so what would I do there? Don't get me wrong i begrudge paying these morons anything but i would rather pay the £60 now than the £100 say next month,also I know they took pictures of my car but would they have took pictures of me either going into the shop alone or coming back out of the shop cos clearly I didn't have my kids with me!

    Please, please, please - stop taking these companies seriously - they are scammers. You also MUST read the Newbies thread.

    As for the photos - if I plucked a random photo off Google and posted it here could YOU name the person ? Even if you could what would it mean ?

    Please lose the victim mentality - that's what these scummers rely on.

    You have 21 days to appeal from either the windscreen notice OR the postal notice. The NEWBIES thread advises why to wait for the postal notice.

    Have you actually read the NEWBIES thread yet?

    When you read the sticky NEWBIES thread you missed this bit

    You always have a case to challenge a private parking ticket, whatever the circumstances even if they have photos.

    Which is right above the the template 1st appeal letter (to be sent after receiving the Notice to Keeper)

    This isn't about what you did or didn't do - it's about the legal reasons why these charges are NOT enforceable.

    Parent and Child parking is provided as a courtesy only.

    You didn't park illegally and you haven't broken any laws here - you broke one of their made up rules - rules they create so they can send spurious invoices to people for money they have no right to.

    Think about it - on a free car park - what have they lost? NOTHING

    Yet they're trying to claim that you briefly parking in a parent and child bay made them lose £100 and now they want it back - but if you pay quick then we only lost £60 - HOW? How did they lose this money? The answer is they didn't - that's one of the reasons why you can and should appeal and with the forum's help you will win and pay them a big fat £0

    As CC says, P&C spaces have no meaning in law whatsoever. In fact, disabled spaces requiring blue badge displayed also have no meaning in law on private land. ;)

    (Not that we suggest people use such spaces unless they or a passenger have a need to do so. But P&C spaces are meaningless).
  • Yes I'm half way through reading the newbies thread,sorry I didn't spot it straight away.I'll wait for the notice to keeper and the appeal it,just panicking a bit as I have been told it can go to a debt collector and then the sum just goes up and up which I know I won't be able to afford! X

    Debt collectors are just private citizens with no special powers . Don't worry about them.
